  • I'm at the MCOL stage with Capital 1. They've acknowledged so have 28 days to get back to me.

They have offered me £88, i'm claiming £377!

I've rejected this (obviously) and sent a letter R/D saying no ta! but i will cancel all claims if they pay me in full!;)

    xx

Hiya Kate - they told me I had to tell the court to cancel my claim so that I wasn't wasting valuable courts time and that they had written to the Court to say they had paid in full settlement of my claim. Yeah, right - I think not
I wrote back to say that what they had told court was incorrect, as they have only offered a refund which will take 14 days to process !!! I also said I would not be cancelling my court claim until I'd received their cheque, and it had cleared, and put c.c. to Nottingham County Court
    Cheeky beggars....

We had the same letter. We just ignored Cap1 until the cheque was in the bank and then, and ONLY then did we cancel the court claim by filling in the form the court had sent us and sending it back.

    Hi

    To anybody who knows.

Im at the stage of doing MCOL but I need to know if Im claiming £1,236 do I add 8% on top of this plus court costs? Would this be the total I would be claiming?

    Total of £1,236 + 8% = £1,334.88 + court costs ?

    Many Thanks In Advance.

You are claiming your claim amount + 8% statutory interest which you get by inserting each and every charge individually in Martin's interest calculator. MCOL will add the court costs automatically.

Cap One - like most other banks - act very petulantly, right til the bitter end. It does rile me when I read their sanctimonious letters, but at the end of the day, we have the last laugh when they pay up :T

    Thank you very much Beate.

Would you also be able to let me know if you know,Ive heard that you can only claim 6 years back from when the claim is put through.

Does it ask you on the MCOL how much you are claiming? Would I put £1,236 + the 8% which = 6 years from the last date on the statements they sent me or have I got to take some off because you have now got to claim from when you submitted it? Eg: 6 years back from tommorrow?

    Confusion  Confusion
