Hi all,
Wondered if I could pick ya brains currently claiming back my bank charges total £993 excl interest:eek: but I also hold a credit card with the same bank currently has a balance of £343 I don't do my personal banking with them anymore have switched to Natwest for that and no longer incur any charges but I wondered when they pay out for bank account charges will they take cc money off that straight away or will they collect that seperately it is my intention to do the same thing to the cc anyway but havent started this process yet however if it is gonna affect my current account pay out it is something I feel would be worth starting sooner rather than later also can any one point me in the direction of some template letters for ccards?
Secondly quite a while ago (but within the sx year limit) I held a topshop account card GE Capital Bank this card had been used and paid the minimum by DD every month however one month they took a payment late by 8days I presumed the payment had gone and used the money from account think I got charged £30 by GE and also bank charges I phoned them and wrote to them several times to try and sort it out no one ever replied to my letters and on the phone they promised to look into it and return my call they never did eventually it spiralled and what was an £11.58p balance became a debt of over £200 I offered numerous times to pay out the money I had origionally owed I got no response around the same time as this I was pregnant with my first and she was stillborn I kind of lost interest in fighting them and they managed to secure a CCJ against me forcing me to pay the balance by underhand tactics I wonder now if there is anything I can do about it the CCJ is settled in full and has been for a couple of years but I still find their behaviour a disgrace and would like to know what I can do about it,.

I'd give MCOL a ring and ask advice from their helpline (best time to ring is first thing, at start of business)

It’s SOB (Standard Operational B*llsh*t).
The Office of Fair Trading’s figure of £12 is still “extravagantly” higher than the cost of automatically administering a late payment and therefore unlawful. All that happens is that the computer adds the charge to your account. I didn't even get a standard letter. The banks and credit card companies always try to use the OFT ruling as justification that the charges as correct.
If the offer is a full and final payment, write to them politely (a judge could read it) refusing the offer. Continue your claim.
If the offer is a gesture of goodwill, write to them politely (a judge could read it) accepting the offer as a "part payment, without prejudice". Continue your claim for the remainder.
Unfortunately, the Financial Ombudsman will only request the difference between the current £12 charge and any older and higher charges so is not an alternative to court proceedings for these claims.
