    You can only file through MCOL if you have an address in England. If your claim exceeds £750, the FO is probably your best option. Have a read of this thread:

    My claim is bordering £750 incl the interest which I could forget about. So I think I will go with Small Claim and hold my breath.

  • update on previous post...i sent a letter explaining that i had not received the cheque they had allegedly sent to me for £190.00 and that if i was them would cancel it as it was sent about 6 weeks ago. i also stated that i wouldn't stop the claim until i received a cheque for the full amount claimed, and that when they send the cheque it would be a good idea to send it recorded and i would pay the recorded charge of £1.05 ( i would rather that, than lose everything). They have defended their claim and sent a letter stating that i had received full payment and that a cheque for £190.00 was sent to me on 9th May and i had omitted to mention this in my claim. i cannot do anything else online now as they have defended the claim. i have received the defense from the court and i have until the 11th July to return it. The letter i sent to cap 1 was signed for yesterday. I'm just hoping they will get back to me soonest as i dont wish to go to court:eek: as i am hopefully starting a new job abroad anyday now and to get back for the court case would mean losing a full weeks wages (more than i'm claiming). oh well can only live in hope

    Hi

    Im claiming from Capital One £1,236.

    Ive sent letter 1 asking for statements which I received.
    Ive sent letter 2 asking for the money back but they offered me as A Gesture Of Goodwil £414 & that this is their final offer.

    Im not accepting this as this is less than half so Im going to be Filing Court Action,to Claim the Charges,Interest & Court Fees as this is what I stated in my last letter.

    1.What I need to know is do I add the 8% interest on top of this? Eg: £1,236 + 8% = £1,334.88 or do I do it on Martins Calculator where I put in the Charge amount & Dates Of Charge?

    2.Will the court fee be the only thing I would have to pay if I lost?

    3.How many days do Cap One get after Ive submitted the claim to maybe pay up?

    4.Ive heard that you have to do the charges 6 years from when you submitted the claim so does this mean that I will be claiming less because in 2001 my charges were £18 & £20 but 2007 they are £12,so I would loose a couple of the £18 & £20 charges wouldnt I?

    5.Where the bank have given me 4 weeks to send back the settlement form for the offer of £414,does it matter if I dont reply because they will see that Ive Filed for Court Action within that time?

    How is your Nat West claim doing
    I have a had a low offer -refused from Cap 1 and will start MCOL next week

    Hi Ripski! Thanks for asking. I'm still waiting for a Court hearing over my Natwest claim, but the good news is that I had a letter today from Capital One offering to pay up the FULL AMOUNT of my claim - charges, interest and court fees :T :T And, as others have reported, that letter arrived 21 days after they were served with my court claim. They have asked me to cancel my court claim, so I shall be writing back to them to say that I will only do that ONCE their cheque has arrived and cleared !!
    Keep at it with Cap One - they always appear to pay up everything before the deadline :T

    RESULT!!!
    I am at courtstage with cap 1, they acknowledged and their 28 days are up on the 19th.
    Great news is i just had a letterstating, it is not their fault, their charges are correct but out of the goodness of their heart they are paying up in full, court charge and full interest!
    £229.31!
    not much compared to some but i did it :) payment will be here within 14days :) !!!:money: :money: :beer:
    So this is in mty garden fund to go towards the bnew decking and fence.
    Only halifax credit card and halifax bank to go...will i get enough to make my garden complete..i hope so :)
    question is they say i have to tell the court they are paying to stop it all. now when should i do this, judgement would be the 19th so 5 days, but cheque can take up to 14??? when do i call te court??

    then today 30th May I got a letter saying they have paid off the balance of my account , and are sending me a cheque for the rest, the letter was dated 25th May.

    I'm well pleased

    The 2nd claim is for £328 + costs and is 10 days behind ,so roll on 10 days time.

    Simply Be - paid up full amount including intrest and costs after 3 weeks with MCOL............£312

    Adams kids store card paid up in full with intrest BEFORE court action started........... £601






    More Good news They I have just got a letter saying they are going to pay my 2nd claim of £328 + costs:T :beer: :j
