Aparrently after spending a few hours surfing ther are a number of people who have manage to claim interest at the contractual rate of the card i.e. my cap 1 is 29.9 % !!!!!!!
Thre are even people who have managed to claim £9.25 an hour for preparing the case!!!!!!
I havnt gone down this route but I have put cap 1 in court , served on the 8th may and lodged a defence on the 11th. They appear to be paying out on 21days after they are served.

We recommend:-
Ignore them and let the BBC know.
The Berwick judgment is subject to appeal.
Opinions so far is that this judgment will cause no problem as it has fundamental flaws in it.
And of course it has no binding effect.
We will update the appeal progress in due course.
However, this may be the case which everyone has been waiting for.
This may be the case which the banks have dreaded might ever occur.

Will keep you posted with timelines on my case as people are looking to see how long it takes and I for one have struggled to find a full case with cap 1 from start to finish

Just commencing Cap 1, who are being a lot more effecient and responsive than Nat West , with whom I eventaully won.
I am half way through trawling , so this message is helpful , have you got a better offer yet or full amount. Do most have to file MCOl to get a revised offer from CAP 1 However I suppose I have to be fair and send further letter asking for a revised offer prior to filing in 14 days

hi need some advise ,have completed moneyclaim on line re capital one. they gave me back £155 of £600 requested. they have decided to defend against my claim does that mean if they win i will have to pay their charges too.
this is getting worse instead of better and to make it worse i live in hull were the judge is making issues of these type of claims i dont know what to do
please help

Unless your claim is over 5K then you don't have a problem, you will only have to pay your own costs. Don't worry about it, and good luck.0

if you look through the capital one thread you will see they always say they will defend...then pay out! I have just received the cheque from them from one account and expect the other cheque to be here in a few days. The full settlement letter arrived on day 21 after they were deemed served.

I received a cheque for the full amount but despite me saying in a letter that I had got married and therefore had changed my name the cheque arrived in Miss X X. I then rang them up and was informed that they needed a copy of my marriage certificate to issue a new cheque. This I did. A week or so later I got a letter in my married name Mrs X X X congratulating me on my married and wishing me well bla bla. In the same post I got another cheque addressed to Miss X X X!!!! I rang them up and they said oops sorry! I needed to ask the bank would they accept the cheque. They did not as I didnt exactly match my account name I rang again on 30 May and said I need a new cheque as this one wouldnt be accepted by the bank. I was assured that another on would be sent. I rang again today as my MCOL runs out on 12 June and I didnt want to start proceedings again. Ive already had a letter from the Court advising me that Capital One have paid me but theyve had 2 attempts and failed both times! I think I'll have to bite the bullet and cancel my claim tomorrow and hope that this cheque arrives this week.
The guy I spoke to had little grasp of English and kept interrupting me - that makes me mad :mad: in itself! but he kept saying I've had the cheque - I know I said but I've still to get one with my correct name on ya numpty!

Hi Susie i think mine might be very similar to yourself i sent my claim to them on the 06/05 and recieved a goodwill offer of £382.00 i am claiming just over 1k so this was not acceptable. I have just done my moneyclaim online today (scary) but my problem is that my name with cap1 is my maiden name and i am now married do you think they will do the same to me? should i send them my married cert with a letter
Also is it true that they are paying out within 21 days i have got to the scary part now i have been putting it off for some time now but feeling quite confident i have read this site back to front i thought i would give it a go.

I've have had 3 accounts with Cap 1.
One is still open.
One is closed.
One was transferred to a collection agency last year.
Am I within my rights to ask that they send a cheque for the amounts that I am recalaiming? They want to credit my account that is open and also credit the account that is with a collection agency.0
