Hi i have had a letter of capital one saying that this is there final offer if i dont accept then i basically get nothing.
Looks like i have a fight on my hands with these i think that it is time to get a mcol filled in.

hi all can sum 1 help me asked cap 1 for me money back on a closed account they owe me £1240 got a offer in the post this morning of £434 ,can sum 1 point me in the direction of saying i will accept this as part payment do i need to write this on the bit of paper offering me this money saying that i will have this as part payment ,cos if i do it on another bit they could get rid of the other bit of paper , also says they will put the money into my account lol wot account i closed it 2 years ago so does that mean they will send me another card better not i dont want another cap 1 .so can any 1 tell me if i accept as a part of the money they owe how long b4 they send u the money lol cos then i will use the rest to take ermm to court cheers jill0

'Thank you for your letter received today.
While you state in your letter that you believe the charges levied are fair, I contend that I do not believe these charges reflect the true cost to Capital One.
The charges, as stated in my schedule provided to you, total £ 518.00 plus, as I believe I have been unlawfully deprived of the money, I have calculated £119.64 interest at the statutory rate.
I therefore ask that you repay me the full amount of £637.64. I have, again, attached a full schedule of the charges and interest with this document.
You have stated in you letter received today that it is your intention to calculate what you believe as fair charges and offset them against my claim and you have advised me that you are crediting my account with £190.00. This credit is not at my request and not what I have claimed. I do not accept these as fair charges. I noted your comments regarding the reduction of fees, but under the Unfair Terms in Consumer Contracts Regulations 1999, charges must reflect administration costs and cannot be punitive. I believe that the charges you have applied to my account have been unreasonable and punitive.
I cannot, therefore, accept the sum of £190 as full and final settlement of my claim for £637.64 referred to in my letter dated April 4th,2007. I will accept this sum of £190 as part payment only, and without prejudice, but will continue my claim for the balance.
I will, however, be prepared to accept a full and final settlement of £518.00, less the £190 you state has been credited to my account, as full and final settlement which are the charges less the interest. Failure to agree this will result in action being taken through the Courts at which time I will request refund of all charges plus interest plus costs.
Please note that, as I have provided clear and documented evidence of my claim which you appear to continue to dispute, I will be instigating Court action in 3days unless you agree my claim.

You prob will not want to use it. However when they paid your balance ,have they also stopped the use of the card or can you still use it.
They haven't said I can't use the card any more,but I'm not going to keep it just in case I'm overcome by temptation:cool:No Unapproved or Personal links in signatures please - FT30 -
Got a letter today from Cap1. Repeating usual story, we are justified etc...blah....blah....blah. As I crossed out the acceptance form part where it states that it would be closure to my complaint and sent them a letter accepting the sum as a part payment without predice. They are not going to pay me the offer of £332 for a claim of £950. Told me its their final offer. So have filled a form to the FO and enclosed all documentation. I know its not any quicker but as I have a few on the go at the same time, can't afford the court route. Lets see.0

It looks like a lot of us are at the same stage. They’ve made me an offer on my 2 accounts, £301 from a claim of £1012 and £366 from a claim of £942.
I will accept the offer as part payment and press on for the rest
As one of my accounts is closed I’m concerned that they may credit a closed account. If so how do I get at that money?
My other account is still open, but again I’m concerned that if they credit the full amount to this account, then it would do so to the tune of around £700.0 -

I am a bit worried. I sent a letter to them requesting bank statements on 22nd May, its was sent recorded signed for with a ten pound postal order and now they are saying they have not received it and that I have to write to another address. Feeling rather peed off to put it politely0
