Hi Ripski - can you point me towards where Martin said that, as I'd like to read up on this.
I originally claimed £260 refund of unlawful fees. I accepted £80 as part payment without prejudice, and today they've offered me a further £120. They acknowledged my MCOL claim the same day they wrote this last letter offering £120
I'm intending to pursue the rest of my fees (they still owe me £60) plus interest plus my £30 court fee

It is a few comments/paragraph at the beginning of the site ,where he gives his general adivce. Following on from Reclaiming Charges he then has a para re credit card charges. I was trawling last night for advice re Cap one. Having reread it then I do not think he is that definate and only opinions. A lot of May and If He still says they are too high at £ 12.00 but just that he would be inclined more to accept this from the creditcard company but no way from a bank
Someone on another thread made the point that OFT recommendation has no standing in law . I also think that and the key is prob., as you are doing, take Court action The credit card companies would, similar to the banks, have a tough time proving the costs are fair and many 'experts' have suggested £ 2 .50 - £ 4.00.
A further point is that how can a £12 00 charge against a £ 20 charge in 2007 be comparable with a £ 12.00 charge against a £ 14.00 in 2000
I don't think they want a court decision either and so will most likely make a better offer Pre Court.
Mind you I am far from the expert and acepted the first offer from Nat west. I did as you suggested and try for one revised offer but they were adamant that it was non negotiable. It is a lot more than I had a few months ago or expected and will sort my overdraft out plus a few other small debts.
I thought that I was going to be the unlucky one who would get nothing or go all the way and then get told it was all my fault anyway!!
So you, Pam and everyone else hang on in there . I feel much more confident now and am going to take on every other charge/store /credit card and I am def going all the way with CAP one.
I am getting the feeling from this thread that those going through the Court sytem get more out of Cap One They aslo seem to be much quicker than the bANKS.
I am not stopping my MCOl claim until my Nat West money is in my account though

Capital One just sent me a letter and they are paying up, the Full amount with interest and costs,
I have two claims with them after they changed there mind not to pay me the 'settlement payment'.
So this was the 1st claim of £773.96 :T :rotfl: :beer: :j
It was started with MCOL on 4th May
deemed Served 9th May
they then acknowledged about a week later
they then put in a defence
then today 30th May I got a letter saying they have paid off the balance of my account , and are sending me a cheque for the rest, the letter was dated 25th May.
I'm well pleased
The 2nd claim is for £328 + costs and is 10 days behind ,so roll on 10 days time.

Hi you need to be aware of anything like this happening.
Yes they can do anything they wish to your account without much reason they have told me with what they have offerd me they would like me to clear the account, I have basically told them i will accept the offer on a part payment and will take them to court for the rest.
They can have there money when i get mine!!! simple as that.
It feels good to be in control, I car'nt wait till they clear my account so i can shut it down, the worse thing i ever did is get a credit card.

Just wondering if anyone has a similair situation to mine they could advise me on please ?
My ex and I paid off our credit card with Cap One when we split up and he kept the card going paying it on time and not incurring any further charges. All the charges are from prior to a period when we zeroed the balance so they have been paid in full. They form no part of the current outstanding balance and so I want the charges repaid direct by cheque and not off the card.
Theyve made a payment off the card for less than a third of the reclaimed amount which I will reject of course.
I have my arguement ready that they cannot force any early repayment on the card without a default notice as per the consumer credit act which is what they are technically doing by refunding to the card and not direct by cheque. I wondered if anyone had done anything similair and what happened ?

Personally I'd ask first and see if they are amenable, if they aren't then I'd cross that bridge when I got to it.Hamsters have no tact and diplomacy, nor do they want any.0 -
It was me !! On another site (Ahem) papers wre acknowledged on the 5th and Cap one paid out yesterday there are 2 cases of this. My papers were acknowledged on the 8th of may so I am expecting payment soon , will keep you informed.
Also as before, people are managing to claim CCI contractual, compound interest and claiming succesfully. This is the rate that Capital One charge you and is a lot more than the 8% that you can claim on MCOL , BUT you cant claim both. Further to this you can also insist that Cap One remove any CCJs or defaults from your credit file.;)

I have since recieved my offer and i have sent it back to them saying that i will accept this offer only as a part payment without prejudice, and will commence court procedings if you do not give me the rest of the money.
At this moment in time i carnt afford to go ahead with the court procedings,
as i am going away at the end of the month and need every penny i have, but i have complained to the ombudsman and they are investigating it for me if they still havent sorted this out by the time i get back i will be sure to go ahead with the mcol.

Cheers Ripski! Cap One have acknowledged my claim, but have paid a 2nd amount onto my card as a 'goodwill gesture' - to date they've refunded me £200. Neither was asked for or agreed to - and they've been told firmly that I only accept them as part payment and without prejudice. I told Northampton County Court who said it was pretty typical of Cap One, who also like paying money into closed accounts, which people can't access. I asked about the business of a court maybe seeing a £12 charge as fair - and was told to ignore that and pursue my claim for the full amount, which of course I plan to do.
They now owe a further £80ish pounds, plus my interest and court fee - can't believe they're being so stubborn over refunding the rest. I have a mental picture of people in suits stomping their feet on the floor saying 'shan't pay, shan't pay' :rotfl:
Sorry Cap One, I aint giving up, and you WILL pay up what you owe me.

You prob will not want to use it. However when they paid your balance ,have they also stopped the use of the card or can you still use it.0
