Someone suggested on here that they think capital one settle 21 days after mcol issued - that fits in exactly to the time scale in my claim so who knows - it may be true....
Thats exactly what i feel is happening , and as my papers were deemed served on the 10/5 looks like we are all going to be watching the post this week!
Presumeably they will then defend saying they have already paid!0 -

Oh it would be sooooo nice to get my money back off Cap One without all the hassle I'm currently getting off Natwest...

Kurt, thanks for the assistance with this. however I forgot to mention that they have in fact sent me a cheque for the £72 which they were willing to refund. ive cashed the cheque and quite ironically the £72 will be used to take them to court. How do I make a claim for the other £180 plus interest? my break down of charges is 9 @ £20 and 6 @ £12. Theyve refunded me 9 x £8 . Would it not be easier to put a claim in for the 9 x £20 plus interest and forget about the interest on the £72 ( as its only a matter of £4 if that ! Or does my claim amount have to match the amount originally requested in my first letter ?0

I have tried to claim back a very similar amount to yours, and I got £150 paid into my account as a "goodwill gesture". This was nice, but I wanted the whole lot back, with interest, so I have sent a further letter. Tonight I find I cannot use my card; they have put a stop on it, although I had £200 to spend on it previously and needed it (partly to take them to court!!). It has made the next few days a bit difficult for me budget-wise, until I get paid again, as I was using the card to pay for train fares into work! So just be warned that they might do something unpredictable; they can stick the knife in once you don't accept their measly offers. I wish I hadn't paid off so much of my credit card now! I don't know if they actually can do this, but I presume so. Anyone know?0 -
Hi you need to be aware of anything like this happening.
Yes they can do anything they wish to your account without much reason they have told me with what they have offerd me they would like me to clear the account, I have basically told them i will accept the offer on a part payment and will take them to court for the rest.
They can have there money when i get mine!!! simple as that.
It feels good to be in control, I car'nt wait till they clear my account so i can shut it down, the worse thing i ever did is get a credit card.

I have decided to accept NAtWest but will not stop MCOL claim until money in the bank and then post on success thread
I am now reclaiming from CAP one .
They sent statements very prompt
There is uch on this site re charges refunded -£ 12.00 .Many are refusing this but no one, similar to other csases has gone all the way to Court.
Martin , the man himself suggests that the court may not look kindly on a refusal to accept £12 as per OFT report
Is it though a bluff and counter bluff ?
If Cap One do ( after delaying) finally offer the full amount rather than risk Court does this suggest that they are not confident about the legalities of £12 charge0 -
Hi just thought i would let you know what i have done just for information i sent for my statements on the 20/4 and recieved them by the 05/05 i sent them a letter on the 06/05 and phoned them on the 18/05 and they have told me they have made me an offer of £382.00 and it was sent out on the 16/05 so i should recieve it soon.
Thing is i am going to refuse this offer as i have put in a claim for £1300. and find there offer insulting!!!
That is my experience so far anyway!!

In my experience, I just rang Cap1 and asked for statement of charges and they sent them free of charge, took about 4 weeks and had to chase them they kept telling me they had sent them.

Hi Ripski - can you point me towards where Martin said that, as I'd like to read up on this.
I originally claimed £260 refund of unlawful fees. I accepted £80 as part payment without prejudice, and today they've offered me a further £120. They acknowledged my MCOL claim the same day they wrote this last letter offering £120
I'm intending to pursue the rest of my fees (they still owe me £60) plus interest plus my £30 court fee
