    hi adwozere thanks for your advice!! i was just wondering i sent a letter to cap1 saying i will accept this offer as a part payment without prejudice but i also signed the form they sent so i could get the money was i right to do this? and also is it worth just going straight to court now what would you advice? i sent there letter back with my letter on wednesday recorded delivery i have given them 7 days should i wait? or just go ahead

    Has anyone here spoken to Cap One about their claims ? What are they like on the phone. I'm toying with idea of ringing up and trying to haggle their offer ? Worth a go ?

    its like banging your head against a brick wall i keep phoning them and basically in so many words they dont talk over the phone they want everything in writing .
    They have information over the phone though yopu have to get threw to the right person but you carnt haggle im afraid;)

    I posted the below a while back and wondered if anyone could advise please ... I have now had a letter from Robinson Way who inform me that C/One have sold my account to them ..............??

    I would welcome some advice as Capital One have really worried and confused me, yet again!

    I had 2 accounts with Capital One (one had £200 limit, the other £400) - cutting a long story short, I had to give up work due to health problems and eventually the CAB made it possible for me to pay a minimum of £1 a month to each account. In the many months it took to get C/One to agree to these payments, they piled on the charges. I received the usual letters from C/One in response to requesting they pay back these charges - they offered £233 as a "goodwill gesture" instead of the full £820.96 on one card; and £120 instead of £369.42 on the other one. I replied to both letters, saying that I would accept (without prejudice) their offers as partial payment but believe that I am still entitled to the full amounts - and that I would commence court proceedings if I didn't receive a satisfactory response within 14 days etc etc.

    The first account: They have replied to this letter, where they offered £233, saying they are confident their fees are both fair and legal - the OFT haven't told them they're obliged to refund any fees etc.... this is their final response and I have the option to contact the Financial Ombudsman Service within 6 months of the letter.... ending with "Again, I'm sorry that I can't refud all of your fees and I hope we can move on from here." ?!?!?! I'd hoped and prayed that I wouldn't have to get as far as the courts but I guess I'll have to see it through now?


    The second account: They wrote to me on 13 April offering £120 (as above). On 30 April they wrote saying they have sold my account to Robinson Way. "This means that Capital One no longer own your account and all future contact about your account should now be with Robinson Way." As yet, I have no contact details for Robinson Way. Any ideas what I should do please?!?!?

    They are giving you BS. You are entitled to the full amount. Their mention of OFT is designed to confuse you, it bears no relation to the truth.

    If you are up to it, send them a letter before action and get ready for a court case.

Something else that is worrying me - as Capital One have now sold my account to another company do I still address my letter to Capital One or do I write and inform the new company??? They knew I was requesting my charges to be refunded - offered me a "goodwill" payment - yet have now sold the account on, also, the amount that the new company say I owe them is minus the "goodwill" payment - aaargh!

    No, your claim is with Capital One. They only sold the debt that was owed by you. They didn't sell the debt that is owed by them to you.
