Don't forget, Tom Brennan's case isn't specifically about the unlawful nature of the charges, he's already been offered them, he's out to get damages on top. So it may not be totally appropriate for what we're doing.Hamsters have no tact and diplomacy, nor do they want any.0 -

I called Capital One to ask them what the cheque I received (£230.83) was for as no letter had been sent to accompany the remittance advice slip. Unfortunately they could'nt tell me!! and I couldn't speak to the necessary department so I have to write a letter.. Oh well, I guess that I will bank the cheque today and then get writing requesting an explanation and the rest (claim was for £600 without prejudice of £714 charges.. where does the 83p come from??!!!).

Am i right in reading that Capital One is only refunding the difference between the old 20 charge and the new 12 charge???? Has anyone successfully claimed back all of the charges they originaly asked for without going to court???

hi ive just read in the sucess storeys that a guy had a closed account wiv cap 1 and he asked for his statements then days later he got a offer which he decided to accept so it dont look like he started court processings hope mine goes that way 2 cos i payed mine of 2 years ago recieved statements a few weeks ago just waiting for a reply but im claiming 1,240 so known my luck i,ll have to take ermm to court cheers john0

i got acknowledgement of mcol from them today and they say they are disputing the whole claim. i think i read somewhere "not to worry" but im just wondering where all this is going. ie, will they go to court, will they file a defence within the 28 days or will they just pay uphalifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j

CapOne have acknowledged my MCOL claim today. I'm hoping they will pay up and not enter a defence - from what I've read in this thread, they often seem to do that. There doesn't seem to be any real pattern though - I think its the luck of the draw, what they decide to do.
I'm already dealing with one lot of Solicitors (Natwest's) and really don't want to have to tussle with any more

i have recieved a settlement of £382.00 this morning i am claiming for £1300.00 so i dont want to ecept this offer
do i
1) Take the offer in partial settlement
2)Not take the offer at all and take them to court
3) Wait to see what the ombudsman says and not sign anything

I was offered £328 for a £1022 claim, I wrote a letter to accept as a part payment and told them I would go to court for the rest, and this is what I did after a week and after a phone call to capital one which they told me the £328 would be in my account in the next few days and they would write a note on my account that I was taking court action. after another week I checked my account and the money still had not been paid in , so I rang them and I was told that they are not going to pay the £328 now as that was a settlement figure only.
So I have ended up taking them to court twice!!!!
So make sure any money they offer, is paid into you account first before you take them to court.No Unapproved or Personal links in signatures please - FT30 -

I would like to emphasize your point also.
My husband was told that a credit was to be on his account on the 17th May. Instead on the 17th we received a letter saying if we accepted it to sign the letter as full and final settlement. Just as well I did not rely on that money being on the account on that date.

Capital One offered the difference as usual £144 out of a £360 claim. I refused and threatened court.
Today got the letter saying not obliged to refund anymore etc etc and they will not write to me any further. They are mugs as I sent letter before saying would accept £300 , now I have no choice but to file MCOL.
Can you add interest as soon as you file MCOL ?
They obviously are banking on the fact people wont fork out the £120. Well Capital One , if you're reading this , You are wrong !!HSBC Claimed £2519 , Paid £2300 - cheque recieved
