Claimed back ......£1622.66p - ( £ 1208.00 + interest £ 294.66 + court fee £ 120.00)
They offered final settlement of £440 twice and I refused
mcol - 30/04/07
deemed served on 05/05/07
letter saying they were paying up - 26/05/2007
won...................£1622.66
.............................................
I kept reading about others winning and was starting to think I would be the one who ended up going to court but this morning got 2 letters - first one said final offer was £440 - no way would they offer any more it was FINAL - also enclosed was ana cceptance form . 2nd letter I opened say they are correct in applying their charges - blah blah.... but as a goodwill gesture they were going to refund the total amount asked for - £1622.66p!
They say I need to write and inform court that they are paying up and to stop the case going any further hmn...... think I'll wait until I have the check in my little mitts first . not that I dont trust them.......
Well done to you :T Definitely wait til the cheque has cleared before cancelling the court claim though

I personally think that capital one is coughing up when people have had a mcol i am actually with the ombudsman on my claim now they sent out a letter basically the same as everyone elses we believe our charges are fair but will offer you this amount which i have accepted only as part payment.
I am thinking it is coming close to there 28 days now and am wondering whether this mcol is the best way to go about it.

Someone suggested on here that they think capital one settle 21 days after mcol issued - that fits in exactly to the time scale in my claim so who knows - it may be true....0

Thanks Megan, I have read that myself on here but it would be my luck it would'nt work like that.
I would just like to hear what the ombudsman say before i go any further, I might phone them on tuesday and see if they have followed threw with my claim. If it is going to be a long wait with them i may aswell go threw the mcol website i have nothing to lose.

It was me !! On another site (Ahem) papers wre acknowledged on the 5th and Cap one paid out yesterday there are 2 cases of this. My papers were acknowledged on the 8th of may so I am expecting payment soon , will keep you informed.
Also as before, people are managing to claim CCI contractual, compound interest and claiming succesfully. This is the rate that Capital One charge you and is a lot more than the 8% that you can claim on MCOL , BUT you cant claim both. Further to this you can also insist that Cap One remove any CCJs or defaults from your credit file.;)0 -
A little help would be appreciated !!
Im in the process of completing my MCOL against Cap One and originally asked for £252.00 in my first letter, however they wrote and advised they would refund only £72 the difference between 9 charges of £20 and their fheir figure of £12. how do i now claim for the other £180.00 and add interest on? does any one have text I can copy and paste ?

use the link to the calculator and claim interest on the full amount, also when claiming with mcol it asks if u want to claim interest if u put yes a page pops up that can be cut a pasted into the claim, just fill in the gaps!;)

Do NOT calculate the interest on the full amount using martin's calculator.
Each individual charge has to have the interest calculated on it you then total each charge's interest then add that to the total.Hamsters have no tact and diplomacy, nor do they want any.0 -

Don't listen to then. You claim for the full amount, not the difference.
£12 was the figure the OFT decided could be considered as being fair. It has no standing in law and Capital One know that.Hamsters have no tact and diplomacy, nor do they want any.0 -
