    Hi guys ..just to say dont give up!!

    As i expected got letters today from Cap 1 for full settlement of charges plus interest on both cards! Cheques for balance to follow! Exactly 21 days since they were served with papers!

    They also said they were defending because they had paid in full!!

    Wont stop case until i have the cheques in my hand though.

    Cap One had charged me about £92 inc interest on certain charges etc.

    I sent them the letters from this site asking for a refund.

    So what they did they refunded me £40 on my account.

    Do guys think I should accept this or fight on for the rest of my money?

    Its all up to u, u can keep the £40 or keep on fightin for your £92 inc interest.;)

    Your claim request has been accepted. The Defendant has 14 days from the date they are served with the claim, to reply.

    Definitely pursue them for the rest !! Be sure to write to them though to say that you only accept the £40 as part payment and without prejudice.

    Capital One sneakily refunded part of the amount I'd claimed onto my account without my permission, whilst my Court claim is going through MCOL. That's another story - I'm insisting they send me a cheque for that amount as my balance is clear and I've no intention of using the card again.

    The officer I spoke to at Northampton County Court said that this is very typical of Capital One, who also have a habit of paying money into closed accounts which people can't access. She advised me to persist with my claim for the rest of the money owed to me. I did mention about the £20 and £12 difference, and that I'd heard that a court might consider the £12 charge to be fair. She said to take no notice of that, and to pursue my claim for a full refund.

    I have just sent my letter of refusal of part payment, which cap1 have credited off my account with their collection agency, this I have no problem with as it reduces my debt. My question now is I am about to fill in MCOL in readiness for when they refuse my request for full payment, as I fully expect them to do and was wondering if anyone else has included charges for personal time etc, letters, phone calls?

    Yeah I did forget to say they didn't give me a cheque but put the £40 back onto account without asking me or telling me!!

    I think i'll go all the way with this one, why not!!??

    Hi i used the calculator on this site..claim 1..£920 plus interest £187

    claim 2 £696 plus interest £167

    grand total reclaimed of £1970 if my maths is correct!!!
