    Cap1 contacted my husband and said a payment was overdue on his credit card. He said as his limit was only £400 but the current balance was £570, and that he had put a claim in for his charges of £950 plus int. That when they pay him his charges - he will pay them. Told them it is awaiting court action.

    They soon changed their attitude and said OK I will note it on the file.

    Not expecting anything to be changed - but at least that told them............

    Hello All,
    Just to let you know that after Martins wonderful advise I have put in my claim with Capital One for their unlawful charges totalling £403.03 (£324 + £79.03 interest).
    Today received a letter from them stating that as a matter of goodwill they would be willing to offer me £112, although this would be £112 more than I had yesterday I do feel that almost a quarter of what I am asking for is not acceptable so I have therefore just posted off my letter to them rejecting their offer & again asking for the full amount otherwise I will start court proceedings...will keep you posted on how I get on!

    after capital one recieved my second letter i got a letter bk sayin that they will need 4 weeks to look into it as im due to have a baby i havent had chance to go up to the courts to file a claim. today i recieved a letter from them sayin that they will not be refundin me(4 days before their 4 weeks was up) so as soon as i have had baby i will be goin upto the court to file on them.
    just thought i'd post so if any of u get a letter askin u to wait the 4 weeks so they can look into it dont give it to them cause they are just stallin and will just say they arent gonna pay.

    I don't think you should have signed the letter they sent with the offer as this said:
    I confirm my acceptance of Capital One's offer to refund fees totalling £xxx.
    This action by Capital One is accepted by me as closure of my complaint.

    As it said at the end 'closure of my complaint' so if you have signed this you have I said you accept the amount they offered and thats it !!

    If I was you I would give them a ring on 0800 952 51 150 and they can get the 'Executive Office' to give you a ring as these are the people who are dealing with all this and they don't take phone calls!! but they might try and fob you off by saying the only way to talk to these people is by sending them letters, This is not true if you insist they will get them to ring you,

    Once you get to talk to these people just say you have changed your mind and you don't want to settle.

    No it doesn't mean that.

    It means that as far as Capital One are concerned the complaint is closed. This informs the person that made the complaint that they either accept what Capital One says or they can now make a further complaint to the Financial Ombudsman.

    You are confusing the statement with "in full and final settlement". It does not mean that the complainant can't make any further complaints of the same nature, i.e. request further refunds.

    :eek: oh darn i have sent a letter and i have signed it but i wrote on the bit i have signed i accept this offer as part payment and signed it have i done it wrong then

    I am sorry i feel a bit silly now i am grateful for all your advice but i am confused if i have sent them a letter and then signed the form aswell (but on the form that i sent i wrote on it i will accept this offer as a part payment without prejudice and then i signed it) does this mean that i cannot take it further should i contact them :confused:

    You saved yourself with the "without prejudice", basically you are saying you are accepting without any conditions they've put on it.

    Claimed back ......£1622.66p - ( £ 1208.00 + interest £ 294.66 + court fee £ 120.00)

    They offered final settlement of £440 twice and I refused
    mcol - 30/04/07
    deemed served on 05/05/07
    letter saying they were paying up - 26/05/2007

    won...................£1622.66

    .............................................

    I kept reading about others winning and was starting to think I would be the one who ended up going to court but this morning got 2 letters - first one said final offer was £440 - no way would they offer any more it was FINAL - also enclosed was ana cceptance form . 2nd letter I opened say they are correct in applying their charges - blah blah.... but as a goodwill gesture they were going to refund the total amount asked for - £1622.66p!
    They say I need to write and inform court that they are paying up and to stop the case going any further hmn...... think I'll wait until I have the check in my little mitts first . not that I dont trust them.......
