From my experience and from what I have read, they do send statements within few weeks and therefore do not take full 40 days. Furthermore, they send the data by next day special delivery, so the risk of it being lost in the post is very low.

My experience is also a few weeks and not 40 days.Very prompt , recorded delivery.0 -

hi i sent for mine on the 20/04 and recieved them by 06/05 and yes mine was the same recorded delivery (lucky it was my day off)0 -
Hi, (I think this is covered in posts 709 - 71* above - sorry for the repitition but I am quizzical over having received no letter to accompany the cheque?)
Advice please. I Know this is a case of personal opinion but.. I have requested £600 charges back from Capital One from a total of £714 (closer to £1000 with interest if going to court). I today received a cheque for £230.83
on a remittance advice slip, with no letter explaining why or how? Do I cash this and send a thanks for part payment but would like rest - IF SO , does anyone have a template letter for me - OR do I return the cheque to them and request the whole amount again... I was surprised to find no letter enclosed.. Couldn't decide if this is good or bad?

You could copy the letter posted by Leaf in an earlier post, saying that you accept it as a partial refund and asking for the rest.
Then bank the cheque!!!!!!!!!!!!!!0 -
Thanks K1mmie.. I was wondering if anyone else had a refund that appeared to be an odd figure, such as mine with 83p on the end? I've begun to wonder because I received no letter that maybe this is for something else? I paid Capital One through Payplan when I got into a mess... whats the possibility that the cheque attached to the "remittance advice" note is from overpayment on what was owed, and my charges refund request is still being looked into? I guess that I will have to call them tomorrow and ask....0

Just an update and some observations for some earlier posts.
Cap1 were very quick and efficient with sending the statements. They responded in good time with their offer on my reclaim request but did not consult at all. They clearly removed the interest on the original claim and offered the difference between the original £20 charges and the £12 charges they deem as fair. They then arbitrarily credited my account with the figure that calculation amounted to.
I sent the above letter and they quickly responded to that too. It is a standardised letter (the signature incorporated in the print) stating 'The OFT haven't told us that we are obliged to refund any fees...'. An interesting twist. The letter went on to say 'Financial regulations require me to advise you that this is my final response in relation to this matter.' and continues to advise that I have the option to contact the FOS.
I might wait a bit to see how the Brennan case progresses before taking it further.
