hi i have the same problem with capital one and would like to know if there is anybody that has won with them without having to go to court my claim with them is for £1300. and they had offerd me £382. as this is so much lower i want to refuse this but would like to know where i stand before making a hasty dission. When i started with these claims i said i would take it all the way now i feel that they have my hands tied with what they have come back with also i have been on the ombudsman website and they have said that £12.00 basically isnt to bad in so many words i dont want to get in to deep and lose Has anybody challenged capital one with this?

I have a similar question . I am just starting a claim against. Cap one credit card I wondered if the enquiry /report ( a few months ago) which decided that £ 12 ;00 was an appropriate fee is 'binding. It was not a legal judgement and other financial discussions re banks suggest that the true cost of charges is nearer £2.50. Also the charge fee 2000 was £15 and then £ 18.00 incresing to £20 in 2002 . So £ 12 in 2000 would not have been fair re inflation etc
I am going to start it off with claiming all the charges but any advice re settlement and /or court stage amount wouldbe appreciated

Do you think that what they have offerd me is a fair offer or would you advice to go for more?

Just add the second letter back of Capital one saying the difference between the charges added over the years and the £12 they now charge is all they are refunding.

  • Original charges varied between £18 and £20, so they are offering to pay back the difference, ie £6 and £8 which in 2001 would have been vastly excessive anyway.

But by then the interest will have changed slightly as it progresses day by day so it might be wasted time.

if you use the excel interest calculator thats on this site (not sure where tho) everytime you open it, it automatically recalculates the interest and when you close it, it will ask if you want to save the changes...obviously the answer would be yes. :D
    halifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j
    CapitalOne card claiming £478 (£609.18 inc%) paid £689.71 :j
    Citicards claiming £700 (£888.23 inc%)

halifax bank (account 2) claiming £543.15 (£564.09 inc%) put on hold due to OFT outcome

Possible a bit of a dumb question. But what exactly are you entilted to claim for with credit cards? Obviously overlimit fees are ok, but can you also claim for late payment fees as well?
