    Capital One seem the most stuborn. Seems they want to offer every one the difference of 12 and 20 then ignore everything else.

    I think they are banking that alot of people wont fork out the £120 court costs.

    Not read 1 success about them where hasn't gone to MCOL.

    I have sent the 14 day court threat letter , but predictably ....no response.
    HSBC Claimed £2519 , Paid £2300 - cheque recieved
    Capital One Claimed £300 , £144 offered , court threat 09/05

    They replied to my letter threatening court action, and advised me to take it up with the FO, and said that they would not refund the remainder of the charges.
    I wrote back to say I was filing a County Court claim against them, enclosed the spreadsheet with precise details of what I was claiming (fees, interest, Court fee) less the partial refund I accepted as part payment and without prejudice. It's due to be served on them on the 22nd :T

  • hi all i wrote the second letter to cap 1 three weeks ago said i would take them to court if they didnt pay me back the £864 thats wiv out interest thought i would be kind not adding that any way 2 weeks went by and i didnt have the money as yet to do the court claim as i have gone to montly pay but i have recived a letter 2 day saying they will give me £296 back so when i send this letter back im not going to sign it just going to say i want the whole £ 864 or i will do the court proceedings next week as its pay day just going to give them 7 more days as i cant afford it yet maybe if i give them 7 days more i might just get luckly but i im not holding me breath lol cheers john

    Evening all!

    I've sent my last letter to Cap1 saying no thanks to their offer which was a third of what i am claiming.

    In my claim I have just claimed for the charges not including interest, but I want to know if I am able to add the interest on top when filing MCOL?

    Any help would be appreciated.

    Yes, once you are filing a claim, you are perfectly entitled to add 8% statutory interest per charge.

    But by then the interest will have changed slightly as it progresses day by day so it might be wasted time.

    I would welcome some advice as Capital One have really worried and confused me, yet again!

    I had 2 accounts with Capital One (one had £200 limit, the other £400) - cutting a long story short, I had to give up work due to health problems and eventually the CAB made it possible for me to pay a minimum of £1 a month to each account. In the many months it took to get C/One to agree to these payments, they piled on the charges. I received the usual letters from C/One in response to requesting they pay back these charges - they offered £233 as a "goodwill gesture" instead of the full £820.96 on one card; and £120 instead of £369.42 on the other one. I replied to both letters, saying that I would accept (without prejudice) their offers as partial payment but believe that I am still entitled to the full amounts - and that I would commence court proceedings if I didn't receive a satisfactory response within 14 days etc etc.

    The first account: They have replied to this letter, where they offered £233, saying they are confident their fees are both fair and legal - the OFT haven't told them they're obliged to refund any fees etc.... this is their final response and I have the option to contact the Financial Ombudsman Service within 6 months of the letter.... ending with "Again, I'm sorry that I can't refud all of your fees and I hope we can move on from here." ?!?!?! I'd hoped and prayed that I wouldn't have to get as far as the courts but I guess I'll have to see it through now?


    The second account: They wrote to me on 13 April offering £120 (as above). On 30 April they wrote saying they have sold my account to Robinson Way. "This means that Capital One no longer own your account and all future contact about your account should now be with Robinson Way." As yet, I have no contact details for Robinson Way. Any ideas what I should do please?!?!?

  • Hi, just recieved response from capital One offering goodwill gesture of the difference between original fee and £12 (because they would like to). Has anyone had success in refusing the offer and going for original claim (with or without interest) Would appreciate help and maybe a suggested letter wording.
