    15/05/07 Rang was told they had sent a reply to me on the 4/5/07, which I have never received and was told I couldn't have a cpoy.

    Faxed second letter chasing them by fax giving them 7 days to reply or I would start proceedings.

    Rang back this afternoon as I was niggled by the reply I had received this morning only to be told this time my claim had never been received and that they had verbally put in the request for my claim to the executive department and they had replied on the 4th and they would send me a copy of letter within 7 days:mad: :mad: :mad:

    Received a patronising letter from Capital One today in response to my LBA letter. They have said that they are 'confident that our fees are both fair and legal' and that the OFT ' haven't told us that we're obliged to refund any fees', that they are 'disappointed you're considering court action' and that 'I'm afraid I won't be refunding all of the fees as you've asked'. Finally they said that this was their final response, and they advised me to contact the FO !!!

    I'm assuming this is yet another fob off - should I still file with MCOL? I'm getting so weary of all this hassle to get MY money back. They gave me a partial refund of fees, but I had written back to them to say that I would only accept it as partial payment, and without prejudice. That in itself makes claiming through MCOL more complicated as I'm not sure what I'm claiming now (they gave me the difference between £12 and £20)

    Help, someone !!!

    Hey folks .... have tried lookin thru the thread but head kept gettin fried with lookin!! Do Capital One close down your credit card if you apply for a charges refund? My credit history ain't great ... and need cc for tickets for travellin etc wit work ... so if they close, would make me think twice abt applyin for charges. Cheers for help!

    I might not have the full answer to that but I've had the same response; refunded only any charges above £12, and I'm not happy with it as it means £142 refund when I asked for over £500 including interest. I'm going to try and find out for sure from this forum whether it is possible to reclaim more (anyone help?)(I think it is as £12 is still excessive and the interest can definitely claimed back), and I will probably go ahead with MCOL. According to Martin's advice send another letter saying you are not happy with the response/amount refunded and threaten court action.

    I'm currently underway with claiming against Capital One for £976.

    They have written back and offered me £358 which I am going to refuse, and send my thanks but no thanks letter to them today!

    However, this might be a stupid question to ask, but when the letter template says response within 14 days, does that mean 14 "working days" (3 weeks) or 14 "normal days" (2 weeks)?

    Sorry if i seem a bit thick, but couldn't find the answer on any of the threads.

    Congratulations to everyone who has beaten their respective institutions, and Good Luck to all those currently pursuing!

    i just gave the 14 days (normal)
    the offered me £88 ut of the £326 that i wanted bk an i wrote bk to then explainin i would accept as a partial payment but theyhad 14 days to pay up the rest.
    have u checked ur account cause usually they just put it in without u knowin??/

    I have sent my first letter to Cap 1 and I fully expect to be offered the usual charges minus £12.

    It seens as though some people have dismissed these offers out right.

    In those circumstances I'd accpet the offer without prejudice as a part payment and then continue to try and reclaim the rest.

    Yep, they haven't put anything into my account.

    i'll give them 14 days from tomorrow, before filing MCOL

    Can anyone tell me if anyone has actually had a victory over Cap 1 without filling MCOL ?? (just seems everyone is in the mcol process?)

    Im 10 days the 14 I have given them before I file.

    They tried to fob me off with £144 when claim is £360
    HSBC Claimed £2519 , Paid £2300 - cheque recieved
    Capital One Claimed £300 , £144 offered , court threat 09/05

    Halifax Credit Card - Statements requested
    Halifax Current Account - Statements requested
    Black Horse Loan - Statements requested
    Halifax Mortgage - Need to do next

    Just sent letter of requesting 6 years statements to Cap 1. I closed my account about 2 years ago. Will keep peeps posted !!
