Hi. I am in a bit of a pickle. Cap1 refunded me £32. Told my husband they were refunding £322 on the phone and it would be in account on 17th. It was not in today an he received a letter saying we will credit this sum to you if you sign the letter to say you will accept as complete claim.
Bit bummed out as could have used this money for the weekend!!! What s***s. Say one thing and do another.
Does anybody have a direct number for the relevant department regarding offers, or a fax number???????

hi all wife has just got her statements from cap 1 to day she only had a limit on hers for 400 added all of it up and my god it cums to 1,240 she paid of this account 2 years ago so going to claim this money back didnt think it was this much lol but it will be a bonus if i get it back number i got to phone was 08458 400 400 its the nottingham number if its usefull to any 1 cheers john0

My husband called that number but just got the usual department, who then told him that they had no authority there and any correspondence would have to go to Nottingham by letter only. No consistency.0 -
So far so good.
Phoned cap 1 on 10th May to request statements. Received the last 10 months in the post today.... Each month in a seperate envelope with a payment envelope enclosed in every one!!!
Atleast they were quick I suppose. The remaining 6 years worth still to come, hopefully in one go this time!!!
They owe £240 fromt these 10 months, so I'll expect an offer of £96 for starters. Suppose I may as well wait for the other statements and do it in one go.
Anyone know how long they are likely to take?
ps. Been claiming £3,500 from Lloyds TSB since December last year. Just waiting for my court date now!

'Thank you for your letter received today.
While you state in your letter that you believe the charges levied are fair, I contend that I do not believe these charges reflect the true cost to Capital One.
The charges, as stated in my schedule provided to you, total £ 518.00 plus, as I believe I have been unlawfully deprived of the money, I have calculated £119.64 interest at the statutory rate.
I therefore ask that you repay me the full amount of £637.64. I have, again, attached a full schedule of the charges and interest with this document.
You have stated in you letter received today that it is your intention to calculate what you believe as fair charges and offset them against my claim and you have advised me that you are crediting my account with £190.00. This credit is not at my request and not what I have claimed. I do not accept these as fair charges. I noted your comments regarding the reduction of fees, but under the Unfair Terms in Consumer Contracts Regulations 1999, charges must reflect administration costs and cannot be punitive. I believe that the charges you have applied to my account have been unreasonable and punitive.
I cannot, therefore, accept the sum of £190 as full and final settlement of my claim for £637.64 referred to in my letter dated April 4th,2007. I will accept this sum of £190 as part payment only, and without prejudice, but will continue my claim for the balance.
I will, however, be prepared to accept a full and final settlement of £518.00, less the £190 you state has been credited to my account, as full and final settlement which are the charges less the interest. Failure to agree this will result in action being taken through the Courts at which time I will request refund of all charges plus interest plus costs.
Please note that, as I have provided clear and documented evidence of my claim which you appear to continue to dispute, I will be instigating Court action in 3days unless you agree my claim.

Thanks for this - very helpful. I actually already sent off something very similar today by recorded delivery; but I expressed the same sentiment - I accept as partial offer and without prejudice (as advised by Martin's blog!), and threatened to continue to court for the rest. Yours goes into more detail, so will be helpful if it goes further/to court!0 -
Hi. I hope someone can help. Is there a different letter template we can use for reclaiming credit card charges? I can't find one anywhere.
I used the same template letter for reclaiming credit card overlimit fees, and have had no problems. Just obviously make sure you check that everything still makes sense in the letters you send and the wording is appropriate; the principle of reclaiming is the same for credit card accounts as for bank accounts.0 -
Wondered if anyone could offer any suggestions etc....
I filed a MCOL to reclaim £112. Capital One had already credited our account with £55. But I wrote to C One saying that I wanted the whole amount.
Now I have received a letter saying that C One are defening the claim. Not sure now whether I should of just claimed for the extra amount (£57) bt didn't know how to do this.0 -
Capital 1 Oh dear claim £700 without interest interest as per calc on site = 247 offered today 229. Told its in account will check shortly. another Cap 1 a/c -still awaiting reply. To take or not to take that is the question.

Go for it all - The Halifax did the same to us and just over a week of them saying the where defending the claim they paid up the rest of it.
Just thank them for the £112 and tell them straight you still intend to claim the amount outstanding.
Tell the courts you have received the £112.00 and that you are still going to claim the rest.
