    Hi all advice please... capital one are the only bank/credit card i have charges with now i sent my first letter recorded delivery which reached them on the 1/5/07 anyway, they have now sent me a letter dated 10/5/07 saying it will take one month to look into the claim... so do i leave it a month before i send the second letter :confused:


    i sent my 1st letter and they refunded £88 out of the £326 that i requested as a so called goodwill gesture.i send bk sayin i will accept as parcial repayment and still want the rest then i got a letter this week sayin they need 4 weeks to look at it.so i am un decided whether to let them have it till after i have had my baby (as i am due in 3 weeks) or to just go up to the court next week.

    if i was u i would send them the 2nd letter an see wat reply u get from that and then take it from there

    havent got an email addy for them but if you log into your account online you can send them a mesage from there.

    Hiya - thanks for that info. I've just emailed them to let them know that I'll be taking them to Court shortly if they don't pay up the rest of the money they owe me :rotfl:

    I wrote to Capital One asking for a refund of almost £500 in charges on my credit card (includes interest). Have not had a reply but today noticed on my card that £150 has been paid off! I am assuming this is their attempt at refunding me. Perhaps I will get a letter in the post soon, but I still want the full amount refunded. From reading this thread it looks like Capital One have repaid this way with other people? Any advice on whether I should use the card/touch any of the money. I don't want to use credit cards anyway anymore, but have a hefty bill it might help with. Don't want it to get in the way of my case though.

    hi, if you have money on your cards then it is yours to use. i personally cut my cards up a few years ago due to saying it woiuld really help with this bill" lol, but if its there then its yours toi use. it wont affect anything ongoing with them as statements are full proof of any debits or credits on your account. in my opinion i would give them the 2 weeks as per the template letters. stick to your timings i have.
    when i requested my statements they came quick. sent off requesting charges....nothing, sent off LBA and got a letter 4 days later saying it will take time.. started MCOL on 12/05/2007 so hopefully wont be too long for my money to arrive
    halifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j
    CapitalOne card claiming £478 (£609.18 inc%) paid £689.71 :j
    Citicards claiming £700 (£888.23 inc%)

    halifax bank (account 2) claiming £543.15 (£564.09 inc%) put on hold due to OFT outcome

    Thanks - yes I agree with you and with Martin for advocating not using credit cards! That is my plan ultimately - but it will help me pay the MCOL payment for the claim if I take them and others to court! So when I'm solvent after getting my money back, I won't need it! It saddens me when I realise I wouldn't have had all the debt struggle I've had, without the unfair charges - I've just realised how close the amounts are - I won't be in debt much, if at all after reclaiming. Sad though isn't it, what they've got away with; the stress it causes being in debt for years!!

    Just thought i would post and say i ended up taking Crapital one to court on unfair charges and have won they have sent the cheque to me yesterday the whole process took about 2 months....so those who are put off by their letters and offers dont be..
    you will win at court..although they wont accept liability..ha ha!

    Just need to let off a bit of steam with regard to Cap 1.

    23/3/07 Requested statements todl 28 days
    12/4/07 rang to say statements not arrived, customer service chap, very polite said they had been sent on about the 2/4/07 but he would send me copies of my full statements as it would be quicker.
    25/4/07 received statements
    26/4/07 Posted claim, giving 14 days for response
    10/05/07 Told they were dealing with my claim and I should here something and letter had been sent so should hear early this week
    15/05/07 Rang was told they had sent a reply to me on the 4/5/07, which I have never received and was told I couldn't have a cpoy.

    Faxed second letter chasing them by fax giving them 7 days to reply or I would start proceedings.

    Rang back this afternoon as I was niggled by the reply I had received this morning only to be told this time my claim had never been received and that they had verbally put in the request for my claim to the executive department and they had replied on the 4th and they would send me a copy of letter within 7 days:mad: :mad: :mad:
