I rang 0800 952 51 150 but you still get throught to different country, but if you ask to talk to a manager they might be able to help a bit more.
I just rang to find out about my £328 but they are not sure if they are going to pay it now but they don't know why !!!!!!!!!!!!!!!!

thanks for that have just foned them and for the first time fonin capital one i actually spoke 2 sumone who i could understand cause they were english lol.
anyway he couldnt do anything either because the executive office only send the letters and it takes about 2 days for them do deal with an email sent by them so he is sendin one anyway to let them no i have called.he did say they are usually quite quick but it will take another 28days for it to be sorted.
so wat do u think do i take them court for the £238 they still owe me or wait 28days????0 -

Had a letter back today from Capitol One in response to my first letter saying this would take them a number of weeks to look into and please be patient!!
Have the rest of you had this in response to your 1st letter, should i ognore it and send the 2nd letter with unsatisfactory response, get on with it!!
Advice appreciated xxx

Hi - under the Data Protection Act, they HAVE to provide you with the information you requested. I'd write back to them and point that out to them, and say you'll report the matter to the Information Commissioner if they don't comply with your request.

Was your first letter the one requesting your statements, or requesting a refund of charges?
In any event, stick to the timescale of letters which is advised, and don't be fobbed off by 'it'll take a number of weeks', blah blah'. You call the tune, and not them!

No it was the one requesting all the charges + interest!!
The letter reads! :It's going to take us a while to look into your situation and come back to you with a detailed response. We'll do everything we can to get an answer to you within four weeks of this letter (9th May!)
If our investigations take longer than 4 weeks then we'll contact you....ERM NO YOU WON'T! NICE TRY THOUGH!
I'm sending the 2nd letter tomorrow saying they have a further 14 days of i will commence court procedeings (letter 3, if requesting statements are letter 1)

Hi,
They're not obliged to pay you interest at this stage, just the refund of charges (full amount - not just the difference between the £12 and £20).
You can really only claim interest once you get into the court proceedings.

Thanks for that, I'm just following the steps set out in the Bank Reclaim steps where Martain quotes:
"If you won via the courts, you would be entitled to add 8% interest (not compounded) on top from the date you were ‘first deprived’ of the money (i.e. the date of each charge). Therefore you may want to ask for the interest as part of the initial claim. It's important to understand that you are not legally entitled to interest unless you win in court, yet all prior letters are a tool of negotiation; think of it a bit like haggling.
You may get lucky and get the interest on top, but even if not, the legal feedback I've had is that it’s one route to pushing the bank to settle quickly so it can offer to pay you without the interest"
I'm just trying, if they offer me my charges owed without i'll be happy, anything else is a bonus

i'm claiming 404 back from capital 1. after only the 1st letter I received a letter back saying, sorry but the charges are legal blah blah, and the OFT ruled that 12 is the maximum they can charge and because of this they have reset there limit to 12. as a goodwill gesture they have worked out every time i paid more than 12 in charges and given me back the difference, they gave me 96 dirrectly into my account . I have sent the 2nd letter telling them no chance. Just a warning to others as this seems to be a new tactic. dont fall for it. Im taking them all the way.

Well - it's worth a try, good luck!
Most people are finding that the best they're offered is the diff between the £12 and £20, let alone the full refund of charges. I've sent them the final letter before action, and plan to file on MCOL next week, at which time I'll reclaim the interest and of course, my court fees.

I read with interest (no pun intended) how Cap 1 is now dealing with the reclaim issues.
My husband and I both have cards, albeit chopped up ones, and I started the reclaim process for both at exactly the same time. I have requested full refund plus interest on both.
I received the statements promptly and stayed within the recommended deadlines for each ensuing letter. Requested statements 24/03/07 and received these on 18/04/07. Requested refunds on 24/04/07. Today I received a letter to me saying they would refund the difference between the £12 and the £20 (although this is £16 pound short of the schedule I provided) and another letter to my husband stating, as has been said to a previous poster, that they are behind with processing and looking into the claim and to wait to be patient for 4 weeks and possibly more! Pah!
The letter to me advised that, 'as a matter of goodwill', they have refunded £190 onto my card (did I ask them too??? NO!) which is a mere £447.64 less than I was claiming!
As the interest charges can be a bit of a nightmare to contest outside of Court, I have decided to 'Without Predjudice' accept the £190 as partial payment in my claim, agree to accept full amount minus interest in full and final settlement but if that is not accepted by them tell them to be on notice that I will proceed to court in 14 days asking for judgement of full settlement plus interest and costs of claim.
Just got to hunt about for some help on composing that letter! Anyone know of a link?
