Urgent Help Required Pleassssse!!!!

I have started a claim on against Capital one on MCOL for £1700.00 The problem is that capital one have acknowledged the claim.

Can people tell me do capital one normally defend the claim or do they normally payout before they defend. Please help!!

i started the process of getting my charges back from capital one on the 1st march 2007. i received statements eventually and worked out the charges including interest were £1097.41.

i sent the next letter requesting for the charges to be returned and received a letter on the 4th april stating that it would take 4 weeks for them to look into it...i gave them 2 weeks as stated in my letter.

2 weeks was up today so i phoned to see how it was progressing and was told that a cheque for £248 was in the post. i queried this as it is over £800 what i asked for and was told that the office of fair trading has stated that banks can now charge £12 per late/overlimit charge.

do i still take them to court and take a chance on this being the case or do i discretely tell them where to stick it.

any help plzzzzzzz

Seems to be standard practice from Capital One, have a read through the previous posts. If you receive a "goodwill gesture" have a read through this thread on how to reply to them.

Hi Guys ,

Can someone help me please ?

Basically I no longer have a Capital one account , havent had for years , but Im claiming back £360 charges.

Today received a letter saying that they will only charge me £12 for the charges so as a result will credit £144 onto my account.

Now how the hell will they do this if I dont have an account ? is this a case of a standard letter gone wrong ?

Should I send a letter telling them to swivel , I havent got an account and that I'd accept X amount in a cheque or I will proceed with MCOL ?

The other thing is they said if they dont hear from me matter will be closed unless I write to address etc in leaflet enclosed (and there was no leaflet !!!)

Any ideas , cheers guys n gals

heres the story

i have sent my 1st letter to them and they refunded me £88 but i asked for £326 so sent the 2nd letter sayin i will accept as partial payment and they had till today to respond which they did with a letter sayin that they will look into it but they want 4 weeks to do so. i no it says stick to the time scale but i am 37 weeks preg and will have to go up to the court to file claim on them an already havin pains so not sure if i should.
do u think i should fone them and say they have had their time and i want them to sort it or i will file the court claim tomora or should i just file the court claim tomora anyway???

Samething happened to me just about to go to put in a claim with mcol and they offered £328 from a claim of £1022, so I sent a letter off saying 'I will take this a part payment but it will go to court for the rest',giving them 7 days to reply, but they didn't, so I rang them and they put a note on the system to say it was going to court for the rest, and was told that the £328 would be paid into my account within 5 Days, so I've taken them to court for £694 + £80 court fees.
All that was on the 3rd of may and I have checked my account today and they still havn't paid the £328 in yet !!! so I'm going to ring them again later to find out why.

they paid my £88 wen they said they would do u think i should ring the before goin all the way to court tomora???

has anyone got the number for capital one i have the 0800 952 4966 one but just get through to sumone in a different country and she said she cant help an thye havent got another number which i no they have.she has emailed them to say i have called and i have told her that if i havent heard from them by tomora morning then i will be filin for court.sheasked me to just wait for one more letter from then lol such fun i love this

I rang 0800 952 51 150 but you still get throught to different country, but if you ask to talk to a manager they might be able to help a bit more.
I just rang to find out about my £328 but they are not sure if they are going to pay it now but they don't know why !!!!!!!!!!!!!!!!

Can anyone help please.

I wrote to cap 1 requesting statement but instead i got a response saying they have refunded the difference between £20 and £12 for charges.

The whole reason i wanted my statements was due to me not having a clue on how much in charges i have so they could of made the amount up.

What should i do now?
