Hi all
After submiting my claim to MCOL on 12 April, Ive had a letter today saying that basically they dont accept liability for my claim but 'as a gesture of goodwill' they are refunding ALL of my charges and are sending me a cheque within 14 days. :j They are asking me to contact MCOL and say that they have paid me. Am I right in saying that I should not do this until the cheque is in my sweaty palm?
They also say that they will defend that claim on the basis that they have/will refund my money.
Does this mean that once I get the cheque I can contact MCOL and thats the end of it, ie no court?
I have to call them tomorrow as despite 2 letters and 1 MCOL claim they still are calling me by my maiden name. I dont want the cheque in that name so I need to make sure its the right name!

Sent Cap1 the letter requesting charges 26th April, have heard nothing. Rang 2 days ago, to be told by a chap in India, it appears on our system that a letter has gone out to you, you should get it in about a week.
14 days up now, so going to issue the next letter - have final 14 days. Have added into the letter that further charges are accruing and stated what dates these are.
Don't suppose I will hear anything - nothing new there then!0 -
Hi all advice please... capital one are the only bank/credit card i have charges with now i sent my first letter recorded delivery which reached them on the 1/5/07 anyway, they have now sent me a letter dated 10/5/07 saying it will take one month to look into the claim... so do i leave it a month before i send the second letter0

Today I thought as I have not heard anything I will get online and check my account - just in case. Well no change there. SO called and did a check on telephone details and it said that I had been refunded £35.00 (I asked for £256). That made my balance £205 (my limit is £200) so guess what they will be adding??
My husband was refunded £325 (he asked for £1128 inc int). We have not had a letter or anything in writing to say this has taken place.
So they reckon the money should be on the card by Tuesday. So will check then, if it is a letter asking for thebalance is going out. Either way a letter for court is going out....
My first attempt - and I'm enjoying this!!!!!!!!!!!!!!!

Susie, EXACTLY the same happened to me. Basically you have won, congrats.The bank will defend but only to bid time, so don't worry. You will be sent a “Notice of Defence that Amount Claimed Has Been Paid”. You have to tick the box whether you wish to proceed with the claim or not. Wait until you have the money in your account, then send the form back. You are given a month to do so. Believe me, the cheque will come, but they will draw it out another 14 days or so so DO NOT cancel the claim until you have the cheque and the money is deposited safely in your account.

Well, Capital One haven't replied to my LBA letter, and the deadline is almost up. Looks like I'll be starting a MCOL claim against them any day now.
Having one of those days where I'm FED UP having to hassle for money which is rightfully mine - still dealing with the Natwest sharks

Sent letter to Cap1 12th April for statements. Came pretty quickly. Letter sent 26th April for £253 for me. £1128 husband (inc int). Heard nothing. Called mid week was told a letter should be with you nex week. Thought I would check the account anyway.
Refunded £35 me
£325 husband
Usual process for them from what i have read, so I am assuming letter will be usual letter of difference etc.
When I have the cash in account, will send next letter for the rest!!!!!!!!

Hi ,same happen to me, just wait a week and you will get a letter telling you that they have credit your account with a few pounds as a good gesture. after is up to you. good luck0
