Possible a bit of a dumb question. But what exactly are you entilted to claim for with credit cards? Obviously overlimit fees are ok, but can you also claim for late payment fees as well?
I have claimed for overlimit fees and late payment fees but my mistake was i also claimed for annual fees (£29.00 a year with cap 1)just beaware off this i didnt realise until i read it on one of the threads!!!0 -

Anything that is a smack on the wrists penalty.

Aparrently after spending a few hours surfing ther are a number of people who have manage to claim interest at the contractual rate of the card i.e. my cap 1 is 29.9 % !!!!!!!
Thre are even people who have managed to claim £9.25 an hour for preparing the case!!!!!!
I havnt gone down this route but I have put cap 1 in court , served on the 8th may and lodged a defence on the 11th. They appear to be paying out on 21days after they are served.

Is your bank now trying to frighten you by quoting the Berwick judgment?
We recommend:-
Ignore them and let the BBC know.
The Berwick judgment is subject to appeal.
Opinions so far is that this judgment will cause no problem as it has fundamental flaws in it.
And of course it has no binding effect.
We will update the appeal progress in due course.
However, this may be the case which everyone has been waiting for.
This may be the case which the banks have dreaded might ever occur.

WOW You have done your homework WELL DONE!!
I think that this info will help alot of us cap1 customers as i am finding it hard to find a case with them from the start to the finish i sent my first letter on the 06/05 and had a offer on the 16/05 will be declining this i think as it is short of 1k im sure that this information you have found will put peoples spirits up.:T0 -
Things are going to plan here. i am trying to claim about 150 plus interest, did letters, even had a call from capital one about something else (closed account they owed me 20.00) and she wanted to talk about the bank charges, told me they can offer the difference (eg taking it back to 12.00) i said i was afraid i would have to say no, i explained i knew that i can reclaim all the charges, said i was sorry but i read of people claiming huge amounts and getting it, i only had a few in the whole time the account was open, so really would only be happy to settle for the full amount.
she said she totaly understood but she wasn't autherised to do anything more and asked if anyone had explained about how to take them to court,
told her i knew what to do and she appologised and said i would have to go that route to get any further.
She was genuinley very nice and down to earth.
I filed with mcol and it is classed as 'served' from today. so going well :O)
Capital one have been the best to deal with so far.

just got my statement through from them and saw £12 x 2 on it...gonna start one with them now. im sure they have charged me before so im gonna write the first letter today and post it off tomorrow with my CAG sticker on the envelope. anyone had any success yet with Cap 1??Scrimping and saving!0

i hope so m8 as i too have had it served 19/05/07 and acknowledeged 21/05/07 and if 21 days is correct would get pay out on 30/05/07:T
