Cheers Ripski! Cap One have acknowledged my claim, but have paid a 2nd amount onto my card as a 'goodwill gesture' - to date they've refunded me £200. Neither was asked for or agreed to - and they've been told firmly that I only accept them as part payment and without prejudice. I told Northampton County Court who said it was pretty typical of Cap One, who also like paying money into closed accounts, which people can't access. I asked about the business of a court maybe seeing a £12 charge as fair - and was told to ignore that and pursue my claim for the full amount, which of course I plan to do.
They now owe a further £80ish pounds, plus my interest and court fee - can't believe they're being so stubborn over refunding the rest. I have a mental picture of people in suits stomping their feet on the floor saying 'shan't pay, shan't pay' :rotfl:
Sorry Cap One, I aint giving up, and you WILL pay up what you owe me.

got a letter from CAP 1 today
they offered the full refund back to my account
i claimed £366 initially
they refunded £88 as good will
through MCOL they gave back the full £428 i claimed
£278 difference + £100 interest + £50 court fees

Not really been on this thread as ive been concentrating on my natwest claim which is still ongoing.
I am currently in the process of claiming back my credit card charges so i wrote to capital one sending my list of charges which amount to £523.92 just a few days ago i received a letter saying we add late charges blah blah blah and you agreed to the terms n conditions blah blah but as a gesture of goodwill they are able to offer me £144 as they are going to reduce the fees they have added to my account to £12 each!
After receiving this letter and reading this thread i thought no chance after all theres a lot of difference between £144 and £523.92 so ive continued and sent my LBA.
Do you think ive done the right thing and i should carry on fighting them?

From my own experience and looking through the thread, once you file and they are issued with your claim they will acknowledge and then pay out on the 21st day. I knew from on here exactly when i would receive the full settlement letter, and there it was on the day! So if you want the lot back, im afraid you need to file a claim on mcol or in your local court, Cap 1 dont seem to respond to anything else . Good luck0 -
Hi everyone!
On the 22/04/07 I sent letters to both Capital One and Yorkshire Bank asking for my 6 years worth of statements. The capital One statements I received fine, I promptly sent the 1st letter asking for about £700 (inc interest) to be paid back. I received this letter today:
"When we opened your account in October 2001, we sent you a credit card agreement which stated these fees. By signing and returning this to us, you agreed terms and conditions for the account, including the fees.
As you are probrably aware the Office of Fair Tradingm, OFT, havent challenged the right of banks to charge default fees, but merely the level of those fees. Although we feel £20 is a just fee, we've reduced our fees to £12 so that we're in line with our competitors. I appreciate that you've incurred previous fees at the higher rate, and would like to address this.
I've reviewed your account and, as a matter of goodwill, I'd like to reduce the fee's we've added to your account to £12 each. Ive refunded £189 and you'll see this on your 3rd of June statement"
The letter does go on expaining hows its important to stay in my limit make payments on time etc, but I want at least the charges back with out the interest which was about £500. HOw do I further this now? Do I write to them and refuse what they have offered or just send the next step letter or what? Any help from anyone whose been in this situation muchly appreciated!!!
With regards to the Yoprkshire Bank, I believe the 40 days to be up for my statements on Monday 4th June. I received a letter today basically saying they acknowledge receipt of my correspondance for the charges/statements relating to my accounts, but due to the high volume of requests they are unable to to provide this info in the 40 days and they would like to thank me for my continued patience and understanding in the matter. What can I do next???

Fairly standard response from Capital One as you can see from other user's experiences.

I know it will be just my luck that all the judges in the world make an example of me and all the banks will sue me or something daft. U suggest to go ahead as normal then? You are feeling exactly the same as everyone else .Guilty and inadaquate. I have felt, all along ,as everyone that it was all my fault any way and that the bank/credit company would take me allthe way and a judge was going to make an example of me at the end . I have , eventually got a good offer from nat west. Remember -The banks are on the run .They would not be making such offers if they thought they were in the right ,legally and morally and they have more advanced legal and business brains/knowledge than us. So why are they paying out ?!! Also if your case goes all the way and a judge , just supposing, says you are wrong and the Bank is right The worst caee scenario So what!! will you be any worse off than you are now !! Go for it.0 -

I totally agree with you. We have to keep remembering that they are the defendants, they're the ones paying up their so-called goodwill payments, they're the ones who don't show up in court. They wouldn't be paying out settlements if they were in the right and we were all wrong. I need to keep remembering this during my tussles with Natwests solicitors, especially! By the way, glad to hear they made you an offer of a decent settlement :T
