You all may be interested to know that Capital One have just paid up for bank charges dating back to Feb 1999. The total amount was £591, so not perhaps as much as some, but I'm chuffed to bits none the less.

It was a bit bold going back further than the six years, but I had kept every statement so I knew what the figures were. Following Martin's procedure to the letter, they paid up after the usual letters to put me off (none of these letters mentioned the six year cut-off).

    Hello,

This is my first post on here.

I got a credit card from capital but had to pay a deposit of £250, so that was my own money which would be keep by them.I had a limie of £250 so that was my deposit i paid, now i have charges of £319.
Can i claim these charges back plus my £250 deposit? and what should i put in the letter?
Any advice would be really appreciated

Did you go through any of the process of going to court or was it just done via the letters. I only ask because Mrs Skippy has just received a letter today confirming they are only willing to give back approx a third of the claim and they will not go any higher and will not go any further in the matter. Any bits of info/suggestions would be appreciated. Cheers, Skippy

I followed the templates (which means two letters and then register your money claim online) and got my just rewards. Capital One will try try and fob you off with one or two letters, they may even send you a cheque to tempt you to back off, but see it through and you will be fine.

I was shocked they didn't contest the amounts owing over six years ago, but there you go. I'm smiling!

    Cheers Martin!:money:

    Hi all,

I started a claim on MCOL against Cap 1 last week as after sending them 2 letters they have not offered me satisfactory amount.

Now on my credit file there is a number of missed payments showing against this account. What I would like to know is whether there is a way of getting them to clear these as one could argue that charges made me unable to pay the amounts on time….

Any thoughts on this would be much appreciated?

cap1 have sent me a letter today saying the usual drivel of all charges are legal etc etc. well today is about 21 days after mcol served and in the letter they say they are refunding the full amount claimed (that includes interest and fees). the only problem i have is they said thay had already refunded me £190.00 on 9th may 2007. this sum has not been received. they said they are going to pay the remainder in 14 days and to cancel the claim. i tried to phone them once i got in to speak to someone but because they cancelled my card over 2 yrs ago when i was at another address they wont speak to me because i didnt answer their security questions correctly. anyway they sent me a copy statement for the month 24/04/07-24/05/07 which shows £190.00 going in and on the same day £190.00 coming out and it shows a credit limit of £***.00 and available limit of £***.00 this made me chuckle so much as they refused to replace my card when it ran out in 2005. as they wont speak to me i am having to send them a letter to explain all this and also that i will not cancel the court claim till the FULL amount has been received by me.
