    RESULT!!!
I am at courtstage with cap 1, they acknowledged and their 28 days are up on the 19th.
Great news is i just had a letterstating, it is not their fault, their charges are correct but out of the goodness of their heart they are paying up in full, court charge and full interest!
    £229.31!
not much compared to some but i did it :) payment will be here within 14days :) !!!:money: :money:
So this is in mty garden fund to go towards the bnew decking and fence.
Only halifax credit card and halifax bank to go...will i get enough to make my garden complete..i hope so :)
question is they say i have to tell the court they are paying to stop it all. now when should i do this, judgement would be the 19th so 5 days, but cheque can take up to 14??? when do i call te court??
    kate
Hiya Kate - they told me I had to tell the court to cancel my claim so that I wasn't wasting valuable courts time and that they had written to the Court to say they had paid in full settlement of my claim. Yeah, right - I think not
I wrote back to say that what they had told court was incorrect, as they have only offered a refund which will take 14 days to process !!! I also said I would not be cancelling my court claim until I'd received their cheque, and it had cleared, and put c.c. to Nottingham County Court
    Cheeky beggars....

Hiya jill - moan away, we've all done it ! :D
Cap One seem to follow a classic pattern of offering a part refund (although I got 2 small refunds) and then climbing down a few days before you can file for judgement against them. In their letter offering me the 2nd partial refund, they gave me a leaflet about the FO, said their latest offer was their final word on the matter, and to make a complaint to the Ombudsman.. Ha! They backed down and i'm now waiting for the cheque in full and final settlement of my claim, having told them I want the full amount by cheque, and not refunding to my card.
Keep at it, you WILL get your money!

    Hi,
    Thanks for your reply.

Unfortunately I no longer have my statements. I settled the account around 3 years ago and I didnt keep a copy of my account number. Therefore I am struggling to write a letter?

Hi i think it's best to give them a ring as you should be on the system somewhere and ask them for an account/reference/card number,

They should be able to find you by giving them your name address postcode date of birth etc,

That's what happened to me, but I had already started a MCOL for the balance so I had to do the MCOL for the £328 they said they where going to pay me at the start, so at the end of the day they ended up paying two lots of costs:rotfl: :rotfl: and today I got a letter saying they where paying, so stick to it you will win.

  • Hi all,

Im new to this site, normally on the hsbc one.

Can anyone give me some advice, i ve had a capital one card for about 5yrs now, had a £200 limit, i used that up and was paying it back when i can t remember exactly but had an annual fee go on, then a late payment charge, then consequently couldn t afford to pay minimum amount. By this point i was over my agreed limit, not through spending but charges. I came to an arrangement with them about two years ago where i pay them £10.00 a month dd. This was fine, until the otherday i opened one of my statements( never checked them for ages) (don t tell me off) :o and realised i now owe them about £500. this from what i can see is charge for being over my limit and interest each month and the £10.00 im paying is going nowhere to bring it down.

I ll get to the point now can i claim this all back?
    Who do i write to

Sorry for being so long winded but wanted to get it all off my chest.

In process of claiming back from hsbc so is this exactly the same proceedure.

    Any help appreciated

    desperate lou x

    Hi
Yes it will be the same proceedure as your bank claim.
    http://www.moneysavingexpert.com/reclaim/bank-charges
And if you send you 1st Letter asking for a list of your charges with a cheque for £10 to:

    Capital One;

    Legal Compliance Specialist
    Capital One Bank (Europe) plc
    Trent House
    Station street
    Nottingham
    NG2 3HX

Then the letters asking for your money back to:

    Executive Office
    Capital One Bank (Europe) plc
    PO Box 5281
    Nottingham
    NG2 3HX

    Good Luck:o
