    hi iam about to start reclaiming charges from cap 1 i am sure i have read someware on this site that cap 1 will send u statements for free?
    does anyone know if this is right? and if so so does anyone know the correct phone number my account has been shut for a year and in the hands of a dca

    i rang 08009522244 it is tha account querys line but they sorted it for me.
    be prepared to take it all the way though i am at moneyclaim stage and they have acknowledged claim so i may end up in court but a lot of people say they pay out at last minute so time will tell

    Stephen, is that the case, that the FOS are only offering the difference?

    I have been offered this by all my credit card companies, and was considering the FOS, in line with Martin's current advice.

    Should i be going to court straight away?

    Are there any cases on this site, where the FOS have only got the banks to pay the difference, and not the full amount.

    Hi all,

    Wondered if I could pick ya brains currently claiming back my bank charges total £993 excl interest:eek: but I also hold a credit card with the same bank currently has a balance of £343 I don't do my personal banking with them anymore have switched to Natwest for that and no longer incur any charges but I wondered when they pay out for bank account charges will they take cc money off that straight away or will they collect that seperately it is my intention to do the same thing to the cc anyway but havent started this process yet however if it is gonna affect my current account pay out it is something I feel would be worth starting sooner rather than later also can any one point me in the direction of some template letters for ccards?

    Secondly quite a while ago (but within the sx year limit) I held a topshop account card GE Capital Bank this card had been used and paid the minimum by DD every month however one month they took a payment late by 8days I presumed the payment had gone and used the money from account think I got charged £30 by GE and also bank charges I phoned them and wrote to them several times to try and sort it out no one ever replied to my letters and on the phone they promised to look into it and return my call they never did eventually it spiralled and what was an £11.58p balance became a debt of over £200 I offered numerous times to pay out the money I had origionally owed I got no response around the same time as this I was pregnant with my first and she was stillborn I kind of lost interest in fighting them and they managed to secure a CCJ against me forcing me to pay the balance by underhand tactics I wonder now if there is anything I can do about it the CCJ is settled in full and has been for a couple of years but I still find their behaviour a disgrace and would like to know what I can do about it,.

    Yes they normally clear the outstanding balance before you get your cut,
    Well they do with cap1 anyway if you owe them anything they will deduct from the money that they owe you.

    This is not the case with me they charged me £10 for my statements.
    And then they offerd me a lousy amount so i have done my mcol now and just waiting.

  • after sending them the letter explaining that i hadnt received their 1st cheque, i got a genuine sounding nice reply from the woman dealing with my claim. she apologised profusely that i had not received the cheque and informed their financial dept to cancel the cheque (at my request) and that a cheque for the full amount would be sent out as soo9n as.
    she also explaioned that the funds are paid into the account first and a cheque is formed from the funds in the account (so as they have full auditory evidence for them) and sent.
    i asked about this as my account had been closed for over 2 years and that was the reply i got...so for those who have a negative balance i would be pretty sure that the balance would be cleared and any over balance would be sent in a cheque...just awaiting my cheque now...

    CapitalOne card claiming £478 (£609.18 inc%) paid £689.71 :j
    Citicards claiming £700 (£888.23 inc%)

    halifax bank (account 2) claiming £543.15 (£564.09 inc%) put on hold due to OFT outcome

    Capital one have made me an offer of £128, they charged me £20 evertime i went either overdrawn or for a late payment, i am trying to claim £290 with interest but they said that they will stick to the £12 that other companies charge and what the office of fair trading have said to charge.

    what are people's thoughts,
    Take no notice of Capital One, and hold out for a full refund.
    They tried that with me and quoted the same nonsense. Their 2nd offer was ridiculous also and they also told me it was their final word on the matter and to contact the FO if I wanted to pursue the matter. I wrote back to say I'd take them to court, and filed on MCOL. They filed a defence and then backed down, and have confirmed to the Court and myself that they will give me a full refund - charges, interest and court fee.
    Do NOT be fobbed off with a reduced offer from Capital One !!

    That is great news!!! Did you have to wait long after you put in a claim i wasnt going to do my mcol as i am a bit scared and didnt really want to put myself threw the stress of it all anyway i am glad i have now i opened my mcol on the 12/06/07 and just waiting now the offers that cap1 give is ridiculous if they would have offerd me half i would of took that but we will have to wait and see how it goes for me hopefully i will have good news like yourself. well done you!!!!:T :T :T

    2. No response
    3. Court action - The defaulted - Court ordered them to pay
    4. Nothing/nada/squat

    What are my options, can I get a Baliff to execute a warrant against them, what are the chances of success, what else can I do?

    Are they disputing the judgement? If not, the next step is to issue a warrant for the court bailiff.
