I have succeeded with nat west and am starting Cap one Their tactics are similar -basically delay and try to put you off. There is no consistency other than this .
I stuck to the templates and deadlines and also started a MCOL claim
Nat west told me when I eventually got through on the phone that they were not allowed to negotiate offers over then phone. Others on this site have been able to and even offerred a larger amount over the phone
My daughter with Barclays did not even take on an MCOL. She just sent letters as per templates , was ignored for ages and then got a really good offer
The only certaintly is that you need patience, tenacity and you will get a good amount of your money back.0 -
Cheers! Yes, I said at the outset I wanted a cheque as I wasn't planning to use my card again any time soon.
I don't think it really matters though, whether you've stated that or not - if you go through and MCOL and win (which you will) I'd think you can contact them and just request payment by cheque.

Congrats Pam How is your Nat west going? My daughter got an amazingly good offer from Barclays which she accepted as she neededthe money .It was nearly the full amount ( less interest )anyway . She did not take out MCOl and just went through the templates. She's happy I've replied elsewhere. The only consistency is the inconsistency!!!
Hiya ripski - yes, I'm well pleased to have got my cheque for the full amount off Cap One. I got their first letter (in response to my request for a refund of charges) on 5th April - they offered me £80 :rolleyes: So, it's really only taken me a little over 2 months to have the cheque for £400+ in my hands. I've had to learn patience in this whole process.
As for Natwest, I'm waiting to hear of a court date - I've gone through MCOL, dealt with their solicitors etc. I first wrote to them on 13 March to request a refund of my charges, so its now 3 months down the lineI'm going after them for a full refund - I'm not giving in. They owe me £1400 which I really need right now
The advice I'd give to anyone reclaiming is 'Patience, patience, patience'

Just an update - Capital One paid up in full today - charges, interest and court fees, AND sent me the cheque as requested, instead of refunding it to my credit card. Yahoo :T :T

Congratulations thats brilliant it puts my spirits up when i hear success stories that are with the same companys as myself espeielly now i have gone through the court route when i didnt really want to but really i had to due to capital one being stubborn and not budging on there offer,
I just hope i am not cutting my nose off to spite my face,
Let me no how you get on with your claim with natwest? i have got one with lloyds and to be honest i really dont think i will do the mcol route with them, i am sitting and waiting till i hear i sent my first letter on 20/04 and the second on the 06/05 and i have to wait till the 17/07 before i can go to ombudsman so i think that that is the route i will take. Capital One owe me £1,236.
Does anybody know if it matters if I have gone over the date the bank had asked my to get back to them with a Settlement Form offering me as a Gesture Of Good Will less than half the money they owe me?
What happened was that when I sent them the second letter asking for the money back they got back to me offering me as A Gesture Of Good Will £414 which is less than half the money & to send it back within 4 weeks.If I didnt send this back they are considering the matter closed.
The thing is Ive been finding out as much info I can about the next stage which is MCOL before I proceed as I dont want to get anything wrong & its taken up until now to find out the info.
The letter they sent me states Tues 22nd May 2007 but I did not receive this letter until Sat 26th May 2007 so I counted the 4 weeks from when I received it but they might count it from the date stated on the letter which means they should have received my form by Tues 19th 2007 which was yesterday.
Does this matter? Should I still proceed with MCOL?

Not responding would probably be a sign of a refusal of the offer, so it shouldn't make a difference with your court case.0
