Just an update - Capital One paid up in full today - charges, interest and court fees, AND sent me the cheque as requested, instead of refunding it to my credit card. Yahoo :T :T

Cheers! Yes, I said at the outset I wanted a cheque as I wasn't planning to use my card again any time soon.
I don't think it really matters though, whether you've stated that or not - if you go through and MCOL and win (which you will) I'd think you can contact them and just request payment by cheque.

That sounds pretty much Capital One's style. They sent me a letter offering to settle in full - and when I checked MCOL they'd also lodged a defence. The next day, I got a letter of notice from the Court stating that they intended to settle in full
I'd give MCOL a ring and ask advice from their helpline (best time to ring is first thing, at start of business)

Phoned Capital One today as their 14 days before court action time is up to be told that the department that deals with that don't take phone calls and correspondance is only via post and was I aware this would affect my credit rating anyway.
Is this true to both statements (I don't think the credit rating part is?) and if not then does anybody have a number I can try phoning?0 -
Quick time!! I sent a letter requesting my statements on 8th June which was a Friday so technically they wouldnt have actioned my letter until the Monday & this morning the posty rang the bell at 7am (git) & presented me with a nice C4 envelope with all my statements in that had been sent Special Delivery!! Ok they may drag their feet paying up but jeez I didnt think for one min I would get my statements so quick!!

I did notice that the letter they included in with my statements had no address on it or number but to say to you that ringing would affect your credit score has to be boolarks, I think they are just trying to stop you from ringing. Just file the MCOL if their time is up, from what I have read here they seem to pay up when you do!Official DFW Member 587 :T0 -

They sent my 'charges' really quick aswell but then have ignored me since - surprise surprise!0
