    Just phone them up,they send them free of charge.
    Yes the £12 you can claim back,unless they want to show you/the world,in court,just how much it does actually cost them.

    Thanks for that. I will also ring them to get the ball rolling a bit quicker. Currently claiming against Barclays, gone through MCOL and now being referred to my local court, so although stressfull, I might aswell deal with the stress at once, and get it over with!!

    You'll find Cap One the easiest of the lot to claim from - know what you mean about the stress though - had 3 months of it due to Nastywest :mad:

    I know what a nightmare. Barclays has been going on since Feb 07, but thanks to everyone here, there is hope and it does seem worth it. Now going to try with GE Money... GO GO GO...

    You've just reminded me that GE Money are next on my list - when I managed to escape their mortgage and get with a high street lender, they clobbered me for excessive exit fees which I need to reclaim !!

    Yes it is long winded but the point is I'm looking for at least 75% and not the 25% offered and I know full well that I'm going to have to put a legal argument forward before they pay out anywhere near what I'm asking for. It can't help to show that you understand the reason behind your claim and that they can't just keep fobbing us off :p

    Up to you :) They only try to cover their backs by sending out their long winded letters full of mumbo jumbo - I took no notice of it, and kept my replies short and to the point with the relevant information enclosed. They churn their letters out at the push of a button, and I doubt they even read our replies.

    If and when it gets to court is the time to debate points of law - but you need to be very clear on what you're saying.

  • Hi just found out they have filed a defence with mcol - will they actually go to court - feeling a bit nervous now - any advice anyone?

    Thats normal,then on the 21st day you get a cheque through the post.
    How many days you at now?
    Our 21st is this Monday.
