    Thanks to this wonderful website i sent the 2nd letter (the one you send after you have recieved the list of your charges) on the 8th of June. they owed me around £800 worth of charges over the 5 years i have had the card. C1 replied quite quickly offering me £355 which was the £8 difference from charging me £20 to £12. I accepted it as I only had a £400 limit on the card and C1 have been alright to me when I had requested refunds from charges in the past. Thanks alot moneysavingexpert and keep up the fight guys if a million ants shout at the same time somebody will hear them!!!!:T

    I had all my statements so I just wrote the 2nd letter asking for the money back.. the response is:

    'I've refunded £120 to your account and we will reduce this from your outstanding balance'

    One problem... this account closed a year ago and paid in full so there is no balance to reduce and where's the £120? Obviously a standard letter then :p

    I'll reply with a partial acceptance but I will be continueing my claim and they have 7 days before court action.. I'll allow a couple of extra days for postage.

    It mentions the credit card agreement that I signed which means that I agreed to these fees! but I have to say that I only went over twice and one of these times I rang before hand and said it will be two days late and they said this was fine... two weeks later I got a very abusive call from a collection agency with a lady that was actually shouting at me.. I'd only said hello!!! but they said I had to pay the whole card - I wasn't working at the time and wasn't even receiving benefits so not an option but they 'kindly' allowed me to pay £60 a month which I'm amazed that I managed it... 5 months later it was paid off!

    my conclusion is that they were not helpful so I'm going the whole hog with them!! :D

    Cap One credited money to my account without me agreeing to it - it was for a pittance, compared to the amount I was claiming. They did it a 2nd time with another pittance. I wrote and told them I accepted it as a partial refund and intended to pursue the full amount via MCOL (which was already underway) I also said I wanted a cheque - my account was clear anyway, and I'd no intention of using it again.
    They ignored that letter..... and then paid up IN FULL (all my charges, interest and court fees) 21 days after being served with my claim. The cheque arrived for the full amount a few days later.

    I wouldn't let them get away with even 1p :D

    I will be putting the request for a cheque in bold and in red text just in case!!! I bet they still get it wrong... I once worked in a complaints department and they just cut and paste the account number & address onto a standard letter... the ones that are suppose to have something different are suppose to be delt seperately but no one bothered... 'cept me and one other person out of 20 of us!! :eek:

    I've got two others claims going through and I've only got a partial refund on one and the other is still waiting for a court date for 3 weeks now!! so I was nearly going to accept it for a milli-second but I don't think so now :D

    Hi all

    After many a fraught phone call, many a letter and 2 attempts with a cheque in the wrong name, as of Tuesday I'm the proud owner of a cheque from Capital One numpties for 1106.08!

    It went in the bank yesterday so its resolved at last! :D

    Interesting re exit fees . A few years ago I got similarly clobberred by a company called SWIFT re a secured loan .I argued and argued at the time that they were out of order and did not get anywhere.the financialadivsor at the time was nohelp and I am battling to get straight .However I have kept all the paperwork So any advice gratefully received ?Any suggested threads?
    I have not had time to start trawling re this
    Got a second letter from Cap one .Not going to up their offer Accept their low offer or else They are sure that I do not really want to waste valuable court time!!! Oh No watch me.

    There is a thread on here about claiming exit fees - I'll toddle off and see if I can find it, and edit this post a bit later (Unless someone beats me to it)

    Just checked the balance of the card,on the phone,and its in credit.
    No letters or nothing on MCOL yet,but everything refunded.

    Don't despair all,they pay up,go for it!!!!!!
