Dont worry that Cap One filed defence. They did this with me on 15th June but waited a few days for letter to arrive from MCOL confirming this and it did but also said they had filed defence because they had paid up in full - two days letter received cheque from them for full amount plus interest plus court charges - grand total £1500!
Please dont worry - it will be fine.

Thanks for the info just a couple of questions, When did you open your claim online? and can you find out on the mcol that they have paid you?
Sorry i know that theses are really stupid questions but i am really botherd about this i really didnt want to take the mcol route. Part of me is glad the other part could do without the stress.

Hi just a quick question i am going on holiday next week for a week and i sent my mcol on the 12/06 they have acknowledged the claim on the 20/06.
Is there a timescale on this if they send something out, got so close and i really dont want to delay it. You see i think that because my name in capital one is my maiden name i think that if they do pay up they wiill send the cheque in my maiden name. I sent my a copy of my cert on the 13/06 recorded delivery and they are being really difficault they need two signitures now so i sent another letter 21/06 i hope that they change it over before anything else happens.0 -

This is pretty much exactly what happened to me too. I must say, I did wait til the cheque had cleared before contacting the Court - although they'd have looked a bit foolish if it'd have bouncedCap One really have been the easiest of the lot to claim from :T

yeah 21 days from 20/06.
Don't worry,letter came today from them.

CapitalOne card claiming £478 (£609.18 inc%) paid £689.71 :j
Citicards claiming £700 (£888.23 inc%)
halifax bank (account 2) claiming £543.15 (£564.09 inc%) put on hold due to OFT outcome0 -

Has anybody won through FO with the Cap1?
Sent my complaint to them as not in a rush and the court dates seem to be taking longer anyway. They offered hubby £322 out of £950. Myself £32 out of £350. Final offer.
So passed it on, but wondered what success the Fo had with them.0 -
i have got my money back.
like many on here i had £200 limit. have just claimed £632 in fees added by them .they have paid off my card and sent cheque for remainder( i did have to take it to moneyclaim and they defended) but paid up 1 week before court date,
so to all of you out there worrying like i was dont!!! go for it you can win

I original submitted the claim form via MCOL on 18/05 and the paperwork to this effect came through post a few days later saying deemed served on 25/05 so I had to then wait the 28 days (until 25/06) to see if they put in defence. But they then put in defence on 15th June (which I was able to see online via MCOL) and again paperwork to this effect came through a couple of days later but it also stated then that they defended because they have paid in full.

Check my post no. 13 in the Reclaim Bank Charges Help Thread, it gives you the timings on MCOL. You will not find out via MCOL whether the bank has paid you, you have to check your account (or will get a cheque in the post if account is closed.)
