    My claim is identical to yours.
    Just rec'd final offer (same as first!!) £240.
    I have written refusing and offering chance to pay £632 and save the interest, costs and compensation when it goes to court.
    I intend going thru' small claims court (Scottish claim). Anyone any experience of this? I am not confident FSO will agree to anymore than the £240.

    You say you are with Capital One & that you got back the £632 in charges added by them & that your limit was £200.Was the £632 by them charges on top of the £200 limit so because they were added by them & so they still owed you this?

    Im claiming from them £1,272 & my limit like you is £200 but its gone over the £200 limit now to £257.

    Do you think I might get the £1,272 or do you think they might say I owe them £257? But I dont do I because its their charges that have made me to go over :confused: ?

    i phoned capital none recently and said i wrote in 4 months a go and still havenr got my statemnts, though i didnt, its about time we worked round the system too, and stated i contacted the financial ombs. and they told me to call you for the last time before they file an enquiry...the gentleman said oh sorry ill send it out and guess what got it today, just took 4 days....:beer:

    I appreciate what you are saying and sympathise but keep this simple.
    Youcan claim all the charges for overdue/late payments, unpaid d/d or cheques and fee for going over your overdraft. If it gets to court you can claim interest in the charges (calculate using Martin's calculator).
    Yes, they will continue to ask for the £57 and you should endeavour to pay this as soon as possible to avoid further charges but, it does not affect your claim. The claim is a separate issue. Capital One will probably make repayment directly to your account and not by other means.

    all mine was charges they have paid off my £200 limit and sent cheque for the differance and also sent me a new card so i can use my account again if i wish:confused:
    the letter says they do not accept liability but who cares

    Sent off third letter yesterday - driving me nuts!!

    Do I have to send another list to Capital One of my charges because with my total claim of charges that I filed on MCOL Ive added 3 more charges from the last statements I sent them?

    I think they will pay you on the MCOL,and not the other 3.
    You may have to start MCOL again,for the other 3,if they don't pay up via your letter.

    The other 3 charges were on the MCOL but not on the list of charges that you had to send to the bank with the 2nd letter asking for the money back.

    Should I send them another copy to Capital One with the 3 added charges on or just leave it?

    Do you think that with the £257 which is my balance & that all of this is charges that I would have to owe them this even though its not money Ive taken out?
