  • i've had the same letters from capital one & want to claim mcol ,is it the standard letter what appears on this forum or is there a different one for credit cards?hope you can help,also interest is confusing me.

    Use the standard Bank Claim letters in Martin's article and change any references from

    for direct debit, unauthorised overdrafts and standing orders

    to

    for Overlimits and Late Payments
    Got It & Spent It :dance:
    IKEA CARD = £120 charges = £175 received (146%)
    MARBLES = £450 charges = £370 received (82%)
    I.F. = £494 charges = £494 received (100%)
    CAPITAL ONE = £981 charges = £1,489.03 (152%)
    BARCLAYCARD = £580 charges = £786.12 (136%)
    On Hold :mad:
    A+L = £722 charges (target = 147%)
    BARCLAYS = £1,405 charges (target = 128%)
    BARCLAYS = £175 charges (target = 140%)
    ABBEY = £3,220 charges (target = 148%)

    You have 6 years to claim. Write to them and inform them that you could not persue it further at the time as you could not afford to do so. ;)

    but then how would i get the money if i havnt got the credit card anymore?

    All my claims (listed below) are on closed accounts appart from the Barclays one!

    ive just received an offer from cap one for the £20 charge being reduced to £12? as this is a gesture of goodwill can i accept it without prejudice and continue with my claim? need to get the rest of the £500 back from them but am not sure how to phrase the letter to them...anyone got the exact link to the letter??

    Thank you for your advice it is most grateful i find that thoughout all the claiming with differant banks you learn something new they can fob you off with. It is good to hear that someone has been there before yourself and you are not alone. I really didnt want to do the mcol (but needs most) but i have been very worried about it since i just carnt wait till it is over now.

    As you have not refunded me the full amount of my claim within the timescale I set out in my letter of xx<SUP>th</SUP> April, I have accordingly filed a claim against Capital One Bank (Europe) PLC with the County Court, who will issue my claim against you in due course. For your information, I am enclosing a spreadsheet detailing the full amount of my claim. As you will note, I am also claiming interest and my Court Fees.

    They had sent me a 2nd revised offer letter, at the point I sent the above letter to them.

    hi all i wrote to cap 1 for my charges, which my account has been closed for 2 years now i did get my statements , i wrote asking for just over £1,000 got a letter saying we will give you £434 , wrote back saying i will accept this as part payment without predjuice, waited 2 weeks then i decided to fone up and see wot was happening , the man on the end of the phone said basically cap 1 was only going to give me £434 if i didnt accept that as full final payment i wouldnt even get that, so to me you send your letter back saying u will accept this as part payment it doesnt really matter they wont give u the money , have started mcol so im just waiting to see wot happens , then hopefully when i do get me money can go for lloyds ,mbna and nationwide cant afford all of them at once , so good luck all gill

    Hi Gill this is exactly what has happend to me they make you an offer if you say you will accept as a part payment only then they will give you nout . I have done a mcol on the 12/06 so i am hoping that i hear from them soon. The best thing to do with these i think is either accept there offer or take the mcol out on them (which i have done and i think that most people will agree this is the best option).
    Most people are saying that they are paying up on the 21 days im not sure im not yet at that stage i will let you know what happens with mine!!!

    hi becked i filed mcol on the 28th of june ,keep checking lol to see if sum things happens keep me updated plz as u are futher than me and least i,ll have a idea wot to expect , didnt add interest cos got a bit worried about doing it wrong, but even if i get me £1,000 bac i,ll be happy then i can go for lloyds and nationwide cheers jill
