    Hi jill
I will defo keep you posted its the waiting that is killing me, I have been told that after 21 days they make you an offer then they send you a cheque 10 days after the offer but they want you to stop court procedings apparantly but nobody stops it until the cheque is though there door.
    Which i dont blaim them.
Also i wonder if any one can help me i dont get it lol is it 21 days after the 12/06 when i put in the claim are they making the offer or is it 21 days after the 20/06 when they acknoledge the claim.
I dont understand lol. And i am starting to get a bit worried now as i havent heard anything apart from a letter saying the same amount as what they offerd in the first place saying a final offer take it ar leave it. And if it is 21 days after i put in the claim that would be about now would'nt it.
    Thanks in advance.

  • Hello,

Been lurking for a long while!

Issued a MCOL for £664 back in May and would you believe it, 7 days before the 28 days was up, Capital One have refunded ALL of my claim including court fee to my account on a No admission of liability basis.!!!!!

The funny thing about this is the opening sentence which basically reads

-you've issued a MCOL against us, which has now given me the time & oppotuinity to look at your case properly!- which goes to show......

    KEEP THE FAITH

Thanks to everyone on here for their advice :->

Hi all just recieved an offer on my closed account £268 and as a goodwill gesture they have added another £20 for any interest incured . My claim is for £764 + £259 interest = £1023...Now if I dont reply to the letter will they just send a cheque out or is it best write back refusing the goodwill gesture . They have given me a letter to sign and post back. Any help greatly welcome ...
Degs :j...is it worth phoning the customer services on the leaflet to negotiate like the (halifax) ?
    Im not really mad...

Hi, I sent of for my bank charges quite a while ago and received them within about 2 weeks. I sent my first letter off 2 weeks today asking for the money etc. I rang cap one just before and a nice lady said a letter went out to me yesterday offering £138 ( I am asking for £385) Iam not going to accept this payment so when I get the letter to I send the 2nd letter or shall I just go straight in with the mcol!??? Halifax was so much easier, Just rang them and they give ya your money backl. Also as everyone is asking, my account is closed so how will they pay me,can they pay by cheque?

Hi, I'm claiming £620 from Capital One. They have sent me a letter saying that as a goodwill gesture they will refund £116 + £10 interest.

I don't want to accept this but they have already paid the money onto my card. I only sent the letter asking for the charges back a week ago so do I have to wait another week before I can send the letter threatening court action (I gave them 14 days in my letter) or can I just go straight to MCOL because judging by previous posts threatening court doesn't get a response.

If I do end up filing with MCOL I'm confused about how much to ask for. Do I ask for the original full amount or do I take off the money that have already paid me, if I do this how do I work out interest on the remainder.

    Hope someone understands my waffle.

    Hi
I had sent off request for statements from Cap One on 13th June. I recd statements and sent my request for refund of all charges on 22nd June. Yesterday, I checked my online account with Cap One and they have refunded £168 direct to my account. My refund request was for £588. Does anyone have a standard letter re accepting this refund as part payment only? Thank you....
