    Yeah send them a letter covers it then.

    If you owe them,they reduce the balance,anything over is credit,well,it was with us.

    they cleared my account first then sent me cheque for the differance
    so they basically claimed back nothing as i desputed that i owed them all their charges in the first place.
    i think!!!!!!!!!!!!!!!!!

    Oh well after eventually receiving my statements, I have worked out my claim for the grand total of £340.31. I received another statement today to say they had put £10 in my account as GESTURE OF GOOD WILL and then the next day slapped on a £12 charge !!!!!! was that all about lol.

    Anyways its being sent recorded delivery and hope to hear soon as I will have no hesitation to take it to court, esp when they have no hesitation slapping these charges on.

  • Taken Capital One right through to County Court claim, which they were defending.
    Capital One sent a letter to say in an effort to resolve this matter they were refunding the full claimed amount of £1216.90 to my account.

    I dont want that I want a cheque sent to me which is what I had stated. I have written to them today asking them to send all the claimed amount to me.

    Am I within my rights to do this, they took money from me unlawfully and yes I owe them but I need this money now to pay divorce solicitor and house repairs. Anyone had any luck getting them to cough up and pay directly not to the account?
  • Thanks very much to this site and all of it's members, today 22 days after my MCOL was served to them I have recieved a letter confirming they will send me a cheque within 14 days for the full amount of £954.00.

    Keep positive and I am sure your claims will work out the same.

    CAPITOL ONE CREDIT CARD

    Ammount claimed £408 , NOW £420!!!

    Wrote to capital one requesting statements, had all details within a week.
    Added up charges to a whopping £408. sent first letter, recieved reply offering £112 i.e. reducing charges from £20 down to £12.
    Sent 2nd letter saying will accept only as part payment and i again attatch a schedule of charges, most of which are over limit charges as i have only ever missed one payment!

    One thing i think is really bad is that i have a direct debit set up for the minimum ammount.
    surely the minimum ammount should be whatever ammount plus the over limit amount to bring your account into line!!! Does that make sense???

    Anyway, starting MCOL on line today, going for full amount.

    Hiya - understand exactly what you're saying!
    Good luck with the claim - you'll probably find they refund the full amount around 21 days of being served with your claim - they did that to me.

    I got a letter some time later to say they were increasing the rate of interest, and that if I didn't like it, then I could close the account !!! I of course wrote back and told them they could close my account with pleasure (my account was clear by this time). I sent the card back to them cut up in heaven knows how many pieces :D:D

    hi i wonder if anyone can help me.
    I have just come back from holiday to find a letter from cap 1, I applied my mcol on the 12/06 and they acknoledge the claim on the 20/06 and now they have sent a letter stating that basically they arnt going to budge and the offer they have offerd is there final offer and i shouldnt waste the courts time haha. I just wanted to know if this has happend to anyone else? are they planning to go to court? i am really confused with this.
    Thanks for any advice in advance.

    Claiming £860 inc interest from Capital One. Received an offer for a £153, stating that this was the difference between the £20 original fee and the now reduced fee of £12. Their offer does not inlude any interest. I am aware of the OFT ruling but still think a £12 charge is too high so I wrote to refuse the offer but said I would be willing to accept half of the original claim amount ie for £430. They have refused!!angry-smiley-030.gif
    Has anybody got any advice of reclaiming credit card charges after the OFT ruling.
