hi i wonder if anyone can help me.
I have just come back from holiday to find a letter from cap 1, I applied my mcol on the 12/06 and they acknoledge the claim on the 20/06 and now they have sent a letter stating that basically they arnt going to budge and the offer they have offerd is there final offer and i shouldnt waste the courts time haha. I just wanted to know if this has happend to anyone else? are they planning to go to court? i am really confused with this.

Yes, got a similar letter. They said it was their 'final response' and to go to the FO. I wrote back (politely, through gritted teeth) to say I'd be taking it through Court and intended to claim the full amount.
They backed down 21 days after being served with my claim, and settled up IN FULL :T

My charges owed was £180.00 Plus interest so roughly it was £220.00 . They have sent an offer of £88.00 and stated that they would add this to my account. My problem is I no longer have an account with them. It closed when i went bankrupt last year. Is this a generic letter as they have not clearly looked into my situation individually?. If i should accept how are they gonna pay me the money? they say they will add it to my account, but they cant?
Please help anyone

It certainly sounds like a standard letter.
Obviously, it all depends on your circumstances and the amount involved (both in real and percentage terms) but, personally, I regard any part offer or payment as an attempt to take some of the charges from you for a second time.
<O:p</O:pIf it is a full and final settlement, write back to the bank, politely refusing it. Continue your claim.
If it is a gesture of goodwill, write back to the bank, politely accepting it as a "part payment without prejudice". Remind them that the account is now closed. How they pay it to you is then their problem. Continue your claim for the rest.

Wow thanks for that quick reply. So i state "accept without prejudice for part payment". and continue great. Is there anything else i need to state in the letter or just those words you quoted.

Dont listen to Capital One.They are just trying to put you off with all the letters that they send you.I got exactly the same letter & many others did aswell.They are just trying to get you to wait longer for your money hoping that you will give eventually give in.That money is yours,not theirs.So ignore them.
File for Court Action on MCOL.
Ask as many questions as you like as everyone on here is very helpful indeed.
Keep us all informed and hopefully we will see your success story on the Success Story forum in days/weeks/eventually to come.

If the account was closed in a debt situation they will open the account and pay any monies reclaimed into that account.0 -

About 12 months ago i started to claim back £608.25p within a matter of days i had £100 in my account i replied saying this was not good enough and court would be the next action i had a letter saying that the £100 was all i would get.
I then fell in to some money isssues and could not see through the court as i did not have enough money to issue the court papers.
But now i can but is it to late because they gave me this £100 and it has been about 12 months does this mean i have accepted there offer?
