Hi, I am in the same situation as you, posted letter requesting statements on 12th June.Recieved statements on 20th June and sent letter requesting refund on 21st June. Now recieved letter offering £256 + £20 but my refund request is for £800. I also want to send a letter accepting as a part payment only. Hope someone can help with this

Following on from both mine and Lorna's post. I have now recd written confirmation from Capital One regarding offer (which relates to difference between £20.00 + £12.00 new chgs!). However, I note that there is a section in the letter which states that when I opened the account they sent me a credit agreement which stated these fees, and by signing and returning the agreement I have therefore agreed to the T+C's.... But I NEVER signed the agreement or sent it back to them! Would we also be able to challenge this in the reply re their offer? Any thoughts would be appreciated

i filed for court last weds on capital one cause they refused to pay up so hopefully they will pay up before the 28 days aswell

Why not use the template letter from the bank charges forum ? stating that
I wrote to you on 20/06/07, making the original request for a payment in settlement of my claim. As I have not received a satisfactory response, I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court. wont this do ?

Ive filed for court on MCOL for Capital One on Mon 25th June 2007,Issued Tues 26th June 2007,Deemed Served on Sun 1st July & it was Acknowledged on Tues 3rd July.Now Ive got to wait to see if they put in a Defence by Sun 29th July.

If they do happen to pay me,what do I have to do on the MCOL?

Capitalone refunded charges plus interest and court fee, have not recieved cheque yet so will not cancel court action until I get this .won £582.49 Do not accept first offer

Thats great news i bet your thrilled can i just ask how long it took for them to pay up after you applied mcol. I applied my mcol with them on the 12/06 and they acknoledge the claim on the 20/06 so what do i go off the date i did or the date htat they did it if you understand what i mean lol.

i filed my Cap1 MCOl on thursday so itll be interesting to see if they manage accounts to the same deadlines.. if they do we should be getting acknowledged about the same time.......

touch wood they settle at the 28 days stage!!!

Ive just tried to access my Capital One account online however its not recognising my details?!?

Everything is definately correct... and its been working fine until this morning.

could this have anything to do with the MCOL which was deemed served yesterday?

any ideas??

On a different note.. has anyone had their online access wiped?

Tried getting into the Cap 1 account only to be told my details are nor recognised... Ive triple checked im typing correctly!
