good morning all
well Im off to post my rejection letter (signed for of course)they offered £288 claims for £1023...
14 days to sort it ... wish me luck !Im not really mad...0 -
hi all ,could sum 1 help me plz been looking at the posts but just dont quite know wot to think ,did mcol for mine and hubbys charges now just checked mcol and they both been acknowledged so can sum 1 tell me what happens now cheers jill0

My Mcol has been acknowledged by Cap 1 today too after I completed it on june 29, served yesterday...
should be interesting to see what timescales they stick to and how things progress from now on...
Do they now have 14 or 28 days to put in a defense? Really hoping to get this sorted and out the way without going to court and asap!!
AshFinally getting my finances in order:jHSBC £2518.68 1st Letter 15/05/07, Acknowledged 23/05/07, LBA sent 06/06/07Capital One £1112 Request letter sent, 11/06/07 offer of 348 received, "ill have a part payment pls along with the rest" leter sentBlack Horse £25 supposedly?! - i think not! show me evidence!Halifax lBA sent 20/06, Rejection letter 22/06, Phoned for Reevaluation 25/06 ..the waiting starts0 -

Heres what I found posted on the Help Thread thanks to Beate
Status: Acknowledged
If the bank acknowledges at any time within those 14 days, they now have 28 days from the date of service of the claim form to file a defence. The court will send you a “Notice that Acknowledgement of Service has been filed”. If the bank don’t defend, you can enter judgment by default after the 28 days are up. If that date falls on a weekend, the court allows one or two extra days for them to respond. You will know if you are too early, as the system will simply not allow you to enter any judgment before the time is up.
Status: Defence
If the bank defends before the 28 days are up, you cannot enter judgment or do anything else online anymore. The court will send you a “Notice of Defence”.
If the bank is just biding time before they send you a cheque (and have told you so in a letter already), you might be sent a “Notice of Defence that Amount Claimed Has Been Paid”. You have to tick the box whether you wish to proceed with the claim or not. Wait until you have the money in your account, then send the form back. You are given a month to do so.
If the bank defends with the purpose to go to court, you will be sent an Allocation Questionnaire which you have to fill in and send back to the court. A court date will then be set which you are required to attend. The bank will either settle with you in any way before the court date, or they will not turn up on the day and you will win by default.

hi lorna good luck to you 2 ,i got a offer of £434 from my closed account did mcol for £1.010 and hubbys for £900 which he owes £300 still on , i cant work out how many days they have to sort it either lol first one i done hopefully will be soon cheers jill0

Hi Ashlee.
I was unable to access my account whilst going through this but was able to get access again after a while.Im at the stage of receiving the Notice Of Acknowledgement from the court & I was able to get access to my account before this.
So it was somewhere between 1st letter & Claim being Acknowledge.

I HAD A CREDIT CARD WITH CAPITAL ONE A FEW YEARS AGO THE LIMIT WAS £250 BUT I ENDED UP PAYING £650 BACK DUE TO CHARGES MY ACCOUNT IS CLOSED AND I DESTROYED ALL DETAILS BUT NOW I WANT TO CLAIM BACK THE CHARGES HOW CAN I DO IT AS I DONT HAVE MY ACCOUNT DETAILS.
IF I WROTE TO THEM SAYING WHO I WAS WOULD THEY BE ABLE TO GIVE THE DETAILS STILL?0 -

Yes you can still reclaim. Submit your SAR (Subject Access Request) giving them as much information as possible. Details to include would be your full name and address with postcode and date of birth. Dates account opened/closed might be handy too. Good luck0
