If you're already at the stage of a court claim, it's tough on them. Interest and court fees are now due. They knew the deadline. Continue with the process.
Thanks Nick - looks like it was a waste of a letter anyway as I received an Acknowledgement Of Service today.

Hi all
I am in process of claiming back unfair bank charges etc:
Currently I recieved back £200 from Capital one which they said represented the difference between the old charge amount (£20) and the new charge amount (£12).
However, as I am of the opinion that the charges are unfair PERIOD - i am trying to claim back all of it (£404.96 including interest). My balance is currently £330.
The last letter they have sent, says that they WILL NOT pay any more
money etc, saying that they are only prepared to refund the difference between £20 and £12 as they are "Confident their fees are both fair and legal". They say they "Won't review what they offered"
So what do you fine folks think I should do next? I am happy to take it further but wanted to check with the experts first.
If I DO take it further, what is the next step?
Many thanks0 -

I was in the same boat with another company, and accepted their offer because if they closed my account then i would be worse off.It is your decision in the end,if you could transfer balance or clear moneys owed then go for it.Think you will have to work out ALL the possibilities, and see which one is the best for you.0 -

Just had a letter off Capital One saying the same thing. I am claiming £200 back from them and have only sent off the first letter. The letter todays says they have refunded me the difference off the old charges to what they charge now so have refunded me £80 into my account which should show on Febuarys statement.
I am prepared to go further but can I??
Do i send another letter saying something like
....."the offer is not satisfactory and will only accept it as a part payment for the monies owed, Therefore you have 7 days to reflect this otherwise i will start a claim."0 -
same happened to me. i requested just over 100 and had a latter to say they had refunded 48 onto my credit card (the diff of the old charges). I worte back to say thank you but i will still be claiming the other 100 odd within 7 days. they didn't respond so i started my court claim on the 23rd jan. they have acknowledged it so they now have 28 days.0
