Rang them today and the gentleman who answered had to confirm that he did not need to charge me for the statements. After this he simply said yes no problem 7 to 10 days and they should be with me.0

Just been reading through how people are getting on with Capital One so thought I would put my details down also:
I was originally claiming my bank charges from Halifax and I read that you can also claim from credit cards etc so though what have I got to lose?
I sent the first letter off to capital one whom I have a credit card with and the reply I received was as follows:
"Thank you for contacting us about the charges that we've added to your account. Since you account has been opened on *date* the following charges have been added:
*List of charges*
All of the above charges were added in accordance with the credit card agreement you signed when you account was opened. We've also let you know of any subsequent amendments in writing in advance of the change.
I suggest that if you want to avoid more charges, you need to make sure we recieve your monthly payments on time and make sure you balance doesn't go over your credit limit.
I am sure this answers your query"
I knew they were trying to put me off by mentioning the credit card agreement so I went ahead with my next letter.
Got the next reply from Capital One saying that basically they sent me a credit card agreement when I opened the account and I agreed to these "fees" but as they have recently reduced their charges to £12 from £20, they are happy to reduce all fees I have paid to £12.
I was originally claiming for £268 but they have now offered me £115 as a gesture of goodwill. :mad:
Any amount would really help me out but I sent them a letter back saying I did not accept their offer however, i would settle if they offered me £200 as opposed to their £100 offer or I would take them to court to claim the full amount back plus interest.
At present they've got 5 days left to reply....
I've also sent a letter to them requesting statements for a credit card account I had with them which is now closed - still waiting for a reply to that0 -
hi all,
cap1 missed their last deadline last week, so i began a court claim, although didn't process payment until yesterday.
i recieved a letter from big bobby udy after deadline had passed offering £152 (claimed £260) which i don't want to accept, so processed court payment and draughted this letter:
Dear Mr Udy,
Thank you for your letter, dated 26th January. Unfortunately I am unwilling to accept £152 as full and final settlement; however I will accept this as part payment without prejudice. As this whole matter has not been settled in a satisfactory manner within the timescale set out I have no option but to issue a court claim for the return of these charges. I will be claiming £260 charges, £24.82 interest and £30 court fees.
I have already supplied a full list of charges with my previous correspondence, which I have enclosed again,

i sent of DPA for cap 1 on 30th jan and have recieved a letter saying they are gonna pass on my account details to debt collection agency or start legal proceedings to get the amout i owe them mostly charges....help what do i do i only just sent of request for statements....Hi, we’ve had to remove your signature. can you advise please i sent request fr 6yrs statements of to cap 1 on 30th jan.... i used the DPA template.... today recieved letter saying as i have failed to resolve this account they are gonna pass my file and account history on to S.C.LEATHHAM-LOCKE LLB
They will be instructed to either prepare the necessary paper work and start legal proceedings or employ assistant in field force ?
it says i got 5 days to sort this.... my question is as my limit was only £200 and was mostly paid off untill charges started balance is now £330 !!!
can i write back saying the amount is in dispute due to charges. i am not sure if they can they pass this on to a debt collection ?

You can't say that it is in dispute until you are actually taking them to court.
I would suggest you offer to pay the debt company £1 a week/month to keep them at bay until you can actually start your claim.0 -
Hi. Just thought that I'd add my name to the thread as I've just started court action against Capital one for just over £1000 (inc charges, 8% interest and fees). I've already had an offer to reduce the charges to £12 each but have rejected this.0
