  • Just sent a fax to the Capital One complaints department as I sent a letter to them giving them 7 days regarding my charges unless I would take them to court and its the 7th day today.

    Just sent a fax saying they have until the end of today to get in touch with me or I will start the claim process first thing in the morning :rolleyes:
  • Just about to start filling in the Moneyclaim form this morning - just a quick question.

    I have had another 2 charges since my original letter to Capital One for my claim. Can I now add these on? :confused:

    my husband and i both have cap one cards, he has been charged about £300 in charges, and mine about £500, we simply could not afford the minimum payments, we contacted them and asked them to freeze the interest and stop applying charges, but they continued. I had a letter from injustia yesterday saying a must pay the total balance which is over £900 immediatley or face court action. I am in the middle of trying to get charges from A&L. Can i do the same with cap one, even though the debt as been passed on to a dca? And do i follow the same procedure with Martins letters? Any help would be appreciated, i am at my wits end with cap one. As far as i am aware my oh debt hasnt been past to a dca. :mad:
  • Hi guys, I have a Capital one account with £200 limit, a few months ago I missed a payment as I had not receive my statement and forgot it was due, therefore I had a charge that took me over limit so got another charge for that, I phoned them up and had a moan and they refunded the £24. Now after being in financial difficulties have incurred £60 in charges, send them the 1st letter and they said that have they have refunded charges befre they would not again etc. Is this what you would expect do they only refund once full stop?? Thanks for any help

    I too have a cap one card and also receiving letters from Interim Justitia. Just send them the standard 1st letter from this site with regards to claiming charges back and also CC it to Interim Justitia. IJ will ignore it and continue to threaten, this will go on for a couple of months, and then eventually you will receive a letter from them saying they have handed it back to their clients. Basically they are what they are "threatening letters". I have had this for the past 6 months and nothing has ever come of them, apart from me replying to them with a copy of my first letter (the one for claiming charges and requesting statements), and they just keep ignoring them. They have 6 days left to send my statements then i can go further if they dont, which i will this time, since i have been requesting these for over 6 months.

  • Received Letter From Capital One Saying That They Were Now Charging The Same As Other Credit Cards But The Amount Of £12.oo Is Still Far Too Much As The Money Program On Bbc2 Said The Maximum Amounts For Any Of These Things Should Be £4.50.
  • I reclaimed charges from Capital One and we've agreed a figure. The accound is now closed, how long before I'll get my money. I'm getting impatient now!

    Did you sign an acceptance form because usally on them it states 10-14 working days?

    I sent a letter off to Capital One regarding my credit card account I had with them which is now closed. It was the first letter just requesting statements and this is the reply I got:

    Thank you for taking the time to write to us about the fees we've added to your account.
    I've enclosed copies of all you statements as requested with this letter.
    I understand you think these fees are unlawful and I'm sorry you feel this way. To explain, we automatically added late payment fees if your payment was missed, arrived late or wasn't enough to cover your minimum payment. We also added overlimit fees if your balance went over your agreed limit.
    When we opened your account we sent you a credit card agreement which stated these fees. By signing and returning this to us, you agreed to the terms and conditions of the account.
    As you're probably aware the OFT has challenged the level of bank default fees. Although we feel £20 is a just fee, we've reduced our fees to £12 so that we're in line with our competitors. I appreciate that you've incurred previous charges at the higher rate and would like to address this.
    I've reviewed your account and as a matter of goodwill (:mad: ) I'd like to reduce the fees we've added to your account to £12. This means that I've refunded £40 and sent you a cheque for this amount. It should arrive within 14 working days.


    I thought this was quite funny as I only asked for my statements. They must be getting so many requests they are just assuming that's what people are after!

    However, they didn't include the statements as they stated in the letter and as I originally requested so sent a letter back to them asking for a copy of these. For all I know they could actually owe me hundreds!

    Usual story with cap one, they said their charges were fair etc, in the end refunded £12 for each old charges over their new limit. I said thanks but I want the rest also so filed mcol on 23rd Jan. They acknowledged and said entered a defence but all money + interest and court costs credited to my account on the 12th Feb along with a letter saying their charges are fair, but it would cost them more to go to court etc.
