I'm having this trouble with Capital One. Ignored most of my letters so I filed MCOL on 9th Feb. Now got letter offering to reduce payments to £12 then a letter putting their offer up slightly but saying this was the last they had to say about the matter. Wasn't sure what to do but sounds like if I just hold my nerve a bit they'll pay up eventually!:rolleyes:0 -

Yes, I would put them through as separate claims anyway.0 -

I had exactly the same letter, they filed an acknowledgement to my claim and then also a defence (which worried me slightly) but paid up about a week later. Hold your nerve and they will pay up!0 -

I know in my head if we stick to Martin's step-by-step guide we'll be fine but its just nice to hear from someone who's been in the same situations and that it still works :rolleyes:0 -
Nice, just had an aknowledgment on MCOL and then today a letter arrives offering the full amount back, with interest
Which court do i need to inform as checking the status has been set to "defence filed", do i have to wait for the letter from the court or can i just call up Northampton Court and let them know.553780080 -

so then we are able to claim the reduced (£12/£13) charges whoooohoooo:j
i've been looking for that answer:T0 -
am having problems with cap 1. sent letter requesting information on charges or copies of statements back in december. wrote again to remind them of the 40 day deadline at end of jan. and again last week giving them another 7 days before reporting them to information commission. All letters were recorded delivery but stil have had no replies not even acknowledging my letters, what do i do next, i really need these statements to start my claim?0

Based on the information on this thread - Cap One don't charge for copies of statements, I too simply phoned the freephone number printed on the statements.
I phoned last Friday and ordered them and confirmed there were no charges to pay for ordering them. When I phoned today asking for an update, I have been told that it takes up to 10 days for them to come through so they will be with me on Monday/Tuesday.
If thats the case - its alot less work than waiting 40 days and paying £10 for the pleasure!
Supersal, phone them and ask for the statements directly and put a stop on the cheque!0 -
Hello there
Today is day 28 and altho Cap One acknowledged I have had no letter or info saying they have filed a defence. Do I just go ahead and enter judgment or should I wait and see if I get a letter on Monday (this being a Saturday)?
I guess what I'm asking is will the defence show up online before I get a letter?
Dont want to enter judgement and then find out the filed defence at 5pm yesterday!

EDIT - hang on I think I've made a mistake. They had 28 days to acknowledge but then have another 28days from 'date of service of the claim form' which I think was 3rd Feb so I've got another two weeks to wait! Arrghh!0
