    Can Cap 1 close my account and order me to pay the outstanding amount on the account if I proceed with claiming back charges?

    Hi do you have the number for Capital One? I've been paying £10 a month to Legal & Trade for the card (£200 limit now up to £460) for about 2 years, but CapQuest have just phoned me (horrible, rude people) and said the debt has been transferred to them, cancel the £10 payment and pay them £50 a month from now on! I cannot afford this so they've given me 7 days to send my incomings & outgoings to them. I think I could nearly clear the balance with what Capital One have charged me over the years. So if I begin my claim, can I get CapQuest to hold off as the amount owing will be in dispute?

    i need letter a contact to cap one as they have not rerplyed to me in the 40 days sent out in the letter i sent it recoreded delivery and everything. could someone help me please.

  • In the process of claiming a total of £1549 from Capital one.They have offered me £490 as difference in fees etc,but declined this as per templates on this site.Submitted letter some 10 days ago telling them i will submit a mol if the amount is not paid within 7 days.

    i rang them this morning just incase any letters have been sent,and the lady i spoke to stated that this offer was the only offer,and that this was for a limited time!!

    I stated that i was going to submit a mol by the end of today for the full amount,and she stated that she had dealt with a lot of these and that there was no guarantee i woul get the full amount and that i should take her advice and accept the £490.She was very forceful on the phone and stated again that i could be left with nothing,and that their offer was for a limited time.

    Can see why people get intimidated when applying but the mol goes today.
  • Hi all, I'm trying to reclaim £1080 from capital one for unfair charges, I have sent the first letter off & the reply today was; as a gesture of goodwill we are prepared to refund £326. They have calculated the new charge as £12 & not £20. Obviously I'm not prepared to accept this so do I just send another letter if so is there a download for one.

  • Hi all, I posted my Recorded letter to Capital One on the 31st January. The Post Office assures me that it was received on the 2nd February and signed for. I included a £10 postal order.

    I contacted Capital One on the 22nd February as they had not replied to my letter. They said there was no record of it arriving - after looking at your messages there's no surprise there. Anyone think there may be a gremlin in their mail room?

    Anyway, I was told to fill in a P58 form at the post office asking if the Postal Order had been cashed and also send proof of delivery. The post office said the address was Postal Order Correspondence Security, PO Ltd, 1 Future Walk, Chesterfield, S49 1PF. However, this could take up to 60 days.

    I was also told that I had sent my original letter to the wrong address which was Capital 1, PO Box 5283, NG2 3WT. I was told to write again including another £10 to The Executive Office, ERC Department, Capital 1 PLC, Post Box 5281, Nottingham, NG2 3HX. If I could supply proof that my payment had been cashed it would be re-funded.

    After reading some of the messages I phoned again today and spoke to one of the managers on the 0800 number mentioned. He also stated that the original letter had not been received and was unable to explain how the Post Office had a signature. However, he did say the original address I sent the letter to was correct.

    He has taken my details and assured me that the statements will be with me within 10 days, I assume this means 10 working days.

    I will send another letter tomorrow outlining my call and assuring them I will be happy to receive the information within this time.

    I just wondered how many people on this site have sent letters to Capital One only to be told that they have not been received?

    Oh my God.The boyfriend phoned Capital One today because the 7 days from the second letter were up. He wasn't expecting to get anywhere, to be honest, but the guy checked his file for the claim and said "Oh yeah, a cheque for that will go out in the next days. It was about £130, right?" Erm, he claimed £110, and in the second letter he mentioned the interest he will claim in court which up to now is £29.64. I must say I don't mind them refunding him the interest as well! I will let you all know whether a cheque for £139.64 is received soon. I told the boyfriend not to wait much longer than middle of next week as I don't want to be fobbed off by Capital One and not stick to the time frame - but if there really IS a cheque under way - what a result! :j
    (Unless you all say that's a delay tactic and to file the money claim tomorrow! ARGH)

    Hm. Today a "sod off" letter arrived from Capital One and "because we've previously refunded charges to the value of £124 I'm unable to make any further refunds to your account."

    What do you think? File moneyclaim now or wait till middle of next week for the cheque he was promised on the phone on Friday? I don't like delaying tactics but if a cheque really is to come I am loathe to go through the hassle of filing a claim. Funnily enough the letter is dated 9 February, but only arrived here today.

    Btw, has anyone ever checked the back of their envelopes? It says there "If undelivered please retrun to Captial One"! They can't even spell their own name!!

  • I posted the letter to Capital One on Thursday requesting my statements etc. On the same day I received a letter from them saying

    “I am writing to advise you that your account is no longer being managed by the Dept Collection Agency who were acting on behalf of Capital One. You account has now been returned to Capital One.”

    It gives me the usual options of paying by standing order, paying in slip etc. The date only reads “February 2007” and there’s no account number quoted. As I had 2 cards with Capital One and am paying £1 per month to 2 different DCAs I haven’t a clue what they’re talking about! I hope they’re not going to start putting pressure on again!! When I got behind with my payments they nearly drove me mad with phone calls, so much so that I wouldn’t answer the phone, so I hope to goodness this isn’t going to start up again. I think I will write to them asking which card they’re referring to, letting them know that my financial circumstances are the same and also that I don’t want any contact via phone!

    I’m a bag of nerves already after receiving this letter, so don’t know what on earth I’ll be like once I send off to them to reclaim my bank charges (when I know what they are) – ooooerr! I think I’ll be posting a lot of messages on this site!:o
  • I think that "personal finance management" should be taught in school, then perhaps these bank charge reclaims wouldn't have even made the local paper. As it is, and sadly it is the case with almost all real world issues (taught inthe correct manner IMHO), it is not. I have no problem with reclaiming charges as I have just helped my partner reclaim over £500 from Capital One. Once someone does something that's proven to work then everyone jumps on the bandwagon, it's human nature. As for respecting the T's & C's that you signed when you accepted the account, how come these charges are being refunded in full (with interest) if they weren't "unlawful"?
