You need the first letter giving them 14 days (you will find at the top of this thread). Once the 14 days are up you send second letter (giving 7 days).
Just change the letter to read "late payment and overlimit charges".:rotfl:"Penny Pinching Winch"

I just want to make sure I get this correct."I AM THE GATEKEEPER OF MY OWN DESTINY" Nacho Libre

Hello All
I would be very greatful for some advice regarding claiming back my bank charges.
I started experiencing financial difficulties approx 5 yrs ago and had dd's bouncing, cheques bouncing etc etc and eventually the Alliance & Leicester closed my account . This also happened with a credit card from A&L and one from Capital One.
About 4 yrs ago I started paying a set amount each month to the consumer credit councilling service , to all my creditors. I didnt have any CCJ's but did get defaults.
I feel very sure that a large majority of my debt to banks was made up of charges. They relentlessly continued to apply charges despite many letters from myself and the CCCS saying I was having difficulties and was arrangin a payment plan.
Would it be worth me trying to claim back these charges? I would be happy for them to offset tham against any costs they do feel I owe from purchases etc.
I am going to claim from my main bank account with Natwest which I have not had that many charges with as I didnt use the account a lot at the time.
I feel I am really getting my finances into shape and that it's wrong that I should be paying these extortunate charges back for years to come.
Has anyone any advice or experience on this?
Kind regards0 -
Can someone confirm for me if I'm on the right track with this?
I posted my 3rd letter to Capital One yesterday which according to Royal Mail they got today. It gives them 7 days warning that I plan to use mcol to claim through the courts.
Once I log the claim (Northern Ireland Court) they then have 14 days to submit defence, if they don't I win by default. If they do submit defence they are then given an additional 14 days for further submissons if they don't again I win by default!
Is the above correct? VMT0 -

I have pressed on because 4 weeks down the line is ever closer to the OFT decision which Martin talks about in his most recent video....Almost every thread I have read says stick to your timeline so thats exactly what I'm doing and I think you should also do.0 -
