    I'm in the same boat as Taloola78's mum. About 4 years ago I ended up owing Capital One about £1,000 on 2 cards due to burying my head in the sand (late payment fees and being charged interest (both cards had a £200 limit)). Thanks to the CAB helping me I now pay £1 per month on both accounts which were taken over by Debt Collection Agencies, but it's going to take me forever to pay it off.

    So, if I have read the many posts correctly, I should be able to apply to have some of this money refunded??? [I hope so!] If I can, do I write to Capital One or the Debt Collecltion Agencies for details of my statements. (Sorry if this has already been explained!)

    Uh, they do.

    I just called and was told that they'd apply a £10 charge for sending me them.

    Although maybe it's because I've defaulted and the debt has gone to DC now.

  • Hi thought i would let you all know of my situation of cap one, I added all my charges up anf they added up to £325.27 with interest. I sent the first letter and 2 weeks later i have recieved a letter full of the usual jargon saying that they offer me as a "goodwill gesture" (my backside) of £104. just wrote the second letter saying thanks but no thanks, i would like all of my charges back please. just gonna go post my letter to them now .

    Lets hope that they get the message that i aint no walkover!!!
  • Hi I just got the second letter back after rejecting their offer of 132 on 450 quid saying that that was their final offer. Also they have been threatening to take ME to court through a company called Debitas, of course the 200 I am over my limit is all unlawful charges. I have filed at MCOL. How do you know if they have acknowledged?

    Capital One seem to have a policy to play hard ball and threaten and frighten consumers to the last and make them go the whole mile before eventually refunding 'to save court costs'.
  • I've just contacted Capital One today as I had a credit card with them between 2001 and 2004. I did not have any of my details, but eventually the guy tracked them down for me.

    He asked if I would like statements sent to me...without me asking...and said they would be with me within 7 working days.

    I am looking forward if not a little guilty at going through and highlighting all of my charges...how are Capital One with dealing with these refund claims?

    I have been following tips for claiming charges back, and received about 70% back from first direct. But capital one (credit card) will only offer £259 back on charges of over £1100! I have read Martins bit about the oft stating that credit card charges should be reduced to £12, which is what there offering me, and now i dont know what to do. Has any one else been successfull with this sort of claim? Or should i just take the £259? Help plea:confused: se!
  • I am having the same problem with Capital one. One of feigned ignorance and misdirection. Phoned and asked for statements in first week of Jan, they were very nice about it, also saying how I didn't have to pay. Great, I thought, maybe these will be esier than Natwest. WRONG. A month later they said they didnt have a record of the request so re requested them a day or two before the expiration of the forty days, they claimed they had no record of the request. Threatened to report to Information Commission, Immediately they bowed, changed tone and promised to send out within the hour. ( I recommend using that one, only speak to managers on the 0800 952 number.) Anyway, 1st letter sent a week ago, which according to the customer rep was not recieved. Am going to send 7 day notice letter today, can't see them whingeing about me not keeping guidelines and can smell this going to court from a mile off.

    Good luck with these clowns, get your claws in them and don't let go!

    Just letting you know my experience with CAP One. I've read on this thread and advised others to do likewise to phone up and ask for the statement as they are free. I phoned and ordered these on 8th feb. I phoned on 16th Feb to ask where they were and was informed that they would be delivered within a total of 10 working days from when I first requested them and that I should expect them around 18th Feb.

    A letter came for me dated 16th Feb saying that due to technical difficulties the statements wil now take a further 3 weeks to deliver. :mad: :mad: :mad:

    I was furious :mad: and phoned them up and then completely bypassed the CS agent and asked to be put through to a supervisor. Luckily my account goes back to Jan 2003 but I put the superviser on speaker phone and made her go through each individual statement and read all the charges out to me one by one - the date, type of charge and the amount , whilst I typed them into a spreadsheet. I also told her not to cancel my request for statements :mad: and that I will be checking progress next week and to also make a note that I have phoned and the reason that I phoned. Furthermore I took her full name. :mad:

    I have now sent off my letter to claim £280 for charges and now await with interest (no pun intentded) for the response.

    Did anybody else have this problem or did anyone have more success by paying the £10 and waiting upto 40days?

  • I thought that it was only banks that could be claimed against for charges and not credit cards.
    What makes Capital One different, can charges from other companies be made eg Bank of Scotland.

    You can claim for late payment fees and over limit fees. The cc companies are likely to come back and only offer you the difference between what you had been charged and the OFT recommended £12 however, you can still argue this point too.
