  • Hehe, No answers, but a full payout with interest. I was seriously tempted to continue with the court process to see if i could get any answers....it would have been worth the £500 reclaimed if i did ;)

    At what stage was this please, I take it after the MOL but before the 28 days were up - not in court??

    Did they acknowledge or did you win by default. Sorry for questions but I need to know;)

  • Ok, here are the order of events.

    1) I read here you can get all your statements for free by phoning Cap1. So I do this on 8th Feb

    2) 15th Feb I phone Cap1 about statements and I am told they'll be delivered before 18th Feb

    3) Then a Letter dated 16th Feb arrives and says that there is a technical problem so statements will be delivered in 3 weeks.

    4) SonnyCash hits the roof and lamblasts :mad: superviser, then gets said superviser to read through three years of statements over the phone to look for charges :D .

    Now get this:

    5) Bearing in mind points 3) and 4), requested statements arrive in post on 25th Feb. :confused:

    What is going on as I have no idea! :confused:

    I sent a letter off to Capital One regarding my credit card account I had with them which is now closed. It was the first letter just requesting statements and this is the reply I got:

    Thank you for taking the time to write to us about the fees we've added to your account.
    I've enclosed copies of all you statements as requested with this letter.
    I understand you think these fees are unlawful and I'm sorry you feel this way. To explain, we automatically added late payment fees if your payment was missed, arrived late or wasn't enough to cover your minimum payment. We also added overlimit fees if your balance went over your agreed limit.
    When we opened your account we sent you a credit card agreement which stated these fees. By signing and returning this to us, you agreed to the terms and conditions of the account.
    As you're probably aware the OFT has challenged the level of bank default fees. Although we feel £20 is a just fee, we've reduced our fees to £12 so that we're in line with our competitors. I appreciate that you've incurred previous charges at the higher rate and would like to address this.
    I've reviewed your account and as a matter of goodwill (:mad: ) I'd like to reduce the fees we've added to your account to £12. This means that I've refunded £40 and sent you a cheque for this amount. It should arrive within 14 working days.


    I thought this was quite funny as I only asked for my statements. They must be getting so many requests they are just assuming that's what people are after!

    However, they didn't include the statements as they stated in the letter and as I originally requested so sent a letter back to them asking for a copy of these. For all I know they could actually owe me hundreds!

    Received a cheque in the post from Capital One todayfor the £40 stated above but still no statements so sent a fax to their department that is dealing with it saying I will keep the cheque but will not cash it just yet as I am still awaiting my statements!

    Funny how on my other account they said their charges were fair and won't pay out but oin this account they've sent me a cheque before I've even asked for it! :mad:

    Capquest are a debt purchase company. They have probably bought your debt from Capital One. They can do this, and the debt can be legally assigned by Capital one to Cap Quest. However you have no contract with Cap Quest and any dispute over charges remains with Capital One. If Capquest actually said 'cancel the £10, pay us £50' in that way, then you have grounds to refer their conduct to Trading Standards. They should not be pressuring you to pay more than you can afford. Remember that unlike Capital one, whose card you applied for and then failed to pay, they chose to buy the debt. It is a grubby business well suited to grubby little companies like Capquest.

    I'd suggest that you write to CapQuest saying that the debt is now in dispute and that you are awaiting a response from Capital One? I'd also recommend you consider continuing to pay your £10 per month.

    You could also ask Cap Quest for proof that the debt has been assigned to them if indeed they have bought it. They cannot just phone you and say 'pay us your Capital one debt' anymore than I could phone someone and say that. If the debt has been sold to Cap Quest, and they will tell you if it has, you could ask to see a letter of assignment from capital One. And it is not up to you to contact Capital One yourself and get that!

    This should give you come time to sort out the matter of the charges with Capital One. Even if the amount you get back is less than the debt it may still be sufficient for you to make an offer to Cap Quest to clear the debt. You can probably get a discount of between 20-25% without too much haggling, provided you actually have the money.

    And don't trust Cap Quest. Correspond in writing and ask them to do the same. They are nasty people.
  • Yes - £12 still isn't a fee they can justify.

    Co-Operative Bank: claimed £560, received £575
    BOS Mastercard: claiming £184, 2nd letter sent 27/3/07
    Capital One Visa 1: claiming £439, 2nd letter sent 27/3/07
    Capital One Visa 2: claiming £842, 2nd letter sent 27/3/07

    I had a Capital One credit card a few years ago. The account was closed a long time ago. I would like to request my statements but I do not have my account number etc..
    Will I still be able to get them?

    From another thread, sending them your address and any details you can remember should do the trick for what you need.
  • Still no reply from Capital One as of yet with 2 days to go before letter 3! I'm concerned about all the recent press and what if any bearing this will have on people like me claiming back charges!

    I think a quick 7 day notice of court action will be my choice and MCOL will follow very quickly after...

    so.... my letter is still not tracking.. almost 2 weeks after sending..BUT.. and this is a big but.. neither is my husbands letter that he posted to nationwide 2 days after but from the same post office... starting to wonder if there's a dodgy postie at the post office???... how long do you think i should wait untill i re-send??

  • Hi I am trying to reclaim £60 made up of £12 charges from Cap One, I know its a small amount so am not sure if I should be doing it. I sent them the first letter and had a reply saying as they only charged £12 they would not refund them. I sent the second letter, no reply so I have sent this letter again. I am not sure what to do. If I do that online claim thing what actually happens with it, could anyone do a guide for me please and also if you win the case do they pay the court fee back.
