    maybe give them a ring and say so and so signed for the letter where is it? has the 10 pound beed cashed?

    I am on the brink of taking Capital One to court. They havn't responded to my second letter and it is about a week over the deadline. When I requested statements off them, I phoned them up and they sent out a letter detailing all the charges applied to my account for free. It includes what the charges were for and the specific dates. I am worried that I would need my actual statements for proof when taking them to court. Can anyone help? Cheers

    Capital One have sent my bf's bank statements within 8 days after just one phone request - great so far. The charges total £216.00 of which £106.00 were refunded at the time because of my bf's complaints. Do you think he should when sending the template letter asking for the other £110.00, mention that they have refunded about half the charges in the past and also mention that they now only charge people £12 while they used to charge him £20 every time? (He had the account between 2002 and 2005). Could that make them think more favourably of his request or less? In short: stick to the template or expand?
    Also, has anyone ever settled with Capital One without having to file a claim first?

  • Hi there - I sent both letters out to Capital One and - having heard nothing from them - filed my claim with MoneyClaim on Friday of last week.

    Today I get a letter offereing £253 as a 'goodwill gesture' (I'm claiming for £1289) which obv I'm not giong to take. The thing I'm confused about is that they say in the letter I asked them to 'remove the default notice from your credit file' - I didnt actually do this as I havent defaulted on my credit card.

    Have they just sent me a template letter and forgotten to remove that bit?

    And do I respond to this or ignore it now I've filed my claim?

    Sounds like they've sent the wrong template out.

    If you're already at the stage of a court claim, it's tough on them. Interest and court fees are now due. They knew the deadline. Continue with the process.
  • I asked for my £220 charges to be refunded and got a letter stating goodwill blah blah heres £8:mad: refund for each charge blah blah-- so here's the Letter before action template letter Cap One BLAH BL**DY BLAH.:rotfl:

    I'll let you know what happens next........:D

    Capital one have offered me £490,when my clam is for £1590.I am not going to accept this.In order to respond i was thinking of the following..

    1) accepting £490 as part payment however informing them that i will be actively pursing the remainder.
    2) Informing them that the basis of my claim is the unfair terms in consumer contracts regulations.
    3) that unless the full amount is paid within 7 days i will commence the court proceedings.

    As i no longer have an account with them i feel very comfortable about this,does anybody have any thoughts about the above or any thing else that i should include.

    So I have put that i'm sending the £10 in my letter, but who would I address the cheques to? I was thinking of just addressing them to the normal company name as if i was paying into my account, do you think this is a good idea?

    Also I've just read on the threads that capital one willl send out past statements for free, do you think it is a better idea to go that way rather than data charges? Are capital one quick with sending out past statements or will they mess me around?

    Any advice would be so helpful,
