Follow the steps in Martins article. You need to give them notice that if they don't come to an agreement with you, you will start a court claim. See step 4 of the article.How many surrealists does it take to change a lightbulb?

Yeah, that's what I was doing, it just states that it is possible to skip this bit and take it to court at this stage.

The article says some people skip this bit. This is not recommended. When you issue a county court claim, you must be able to prove that you've made a reasonable effort to settle the claim before going to court. Sending two letters, and giving the bank three weeks minimum to settle, shows you have made this effort.
I recommend you send the next letter giving the bank another seven days notice, or you will issue a court claim.How many surrealists does it take to change a lightbulb?

Hi
I have been trying to reclaim £450.00 from Capital One only offer was £153 so went to County Court.
Paid £50 and papers have been served, they are going to defend claim in full!!!
Has anyone got any advise as to what happens next, will it get to court?

Hi,
I was wondering if someone could please advise me on the following:
I have calculated the charges on my capital one account and they come to £155. In October Capital One refunded £50 of this because I complained about their customer service (gesture of goodwill blah blah blah). £50 is apparantly the maximum they can refund over the phone. On my paper statements they show it as three refunds in October. On my online statements they show as Refund February £20, Refund March £20, Refund April £15.
When I am putting together my spreadsheet I will show this with comments but how should I phrase it in my letter so that they understand why I am claiming a part charge?

I dont think you need to explain, just put in everything as your statements show, including the refunds and this will take it off the total of charges. Or Put all the charges on to start and then the refunds at the bottom and take them away. Ask for what ever is left. Not going to be much so they will probably give it to you back if they know that you are seious.

Hiya, i wrote to capital one to claim back my charges and also miss sold payement protection using the template letters from here.This morning i recieved a letter from capital one stating that they need some time to sort this matter and that they would be responding within 4 weeks is that normal?

Had you just been reclaiming bank charges in the letter I would have just said carry on with the time scale you set and send the next letter but as you are asking about something else too they may well need time to look into that.0
