I sent off my letter to Caital One on Monday requesting £460 charges to be reimbursed to me. Hopefully hear something soon, though I hope they are not going to play hard to get. How long does it take roughly before they reply, anyone got any idea?0

I'm really worried now. I filed my claim against for Capital One on the 22nd Jan. I've justed checked moneyclaimonline and it has been 'acknowledged' and says they have 28 days instead of 14 to reposnd. Do you think this now means they are likely to defend my claim. Its only for just under £200. Help!0

They will probably defend it but don't get too worried. We submitted ours on the 22nd with Capital one for around £500 and our moneyclaim also says 28 days lol. :eek:553780080 -

Hi, if its still not been delivered send it again to Nottingham. I sent mine there about 3 weeks ago & have just recived the statements. Don't forget to send everything recorded delivery. Good luck. SUFC. :cool:0 -
This may be of intested to some of you MSEs
I started a claim with Cap One on the 15/1 their response was "as a matter of goodwill I'd like to reduce the fees we have added to your account to £12, So I can do these refunds totalling £106" (I asked for £220 to be taken into account!)
As your account was partially settled (through 3rd party DMP) there is still a balance of £82.xx. If you accept the refund then your account will be settled in full and I'll notify the credit ref agencies of this. I'll then send you a cheque for £19.xx  (What)
I do not owe this money to them; it sits there and I am not liable, yet they want to clear this with my (money) refund of charges. I think not, replying to Cap One as soon as - Answer will be No thankyou to £106 and not into your pocket. If it hadn't been for these charges. I'd still be in the black!! (and probably still a good customer.I'm just looking, I'm not buying.............

Hi there, I was hoping you would be able to help me out. Ive been following eveything to do with reclaiming bank charges and i am currently in the process of doing it with LloydsTSB (I will let you know how i get on), but currently i am doing it with my Capital One credit cards. I need your advice as you have never mentioned anything about doing it with credit cards and i am not sure how entitled you are like the banks.
I have two credit cards with Capital One, one VISA and one MASTERCARD. I have been using your template letters and i am claiming to include interest. (I used your interest calculater on the website). I have now recently had a letter back from both offering a settlement which is way below what i originally asked for. When it comes to the banks you say they may offer you a settlement but if you continue through the small claims you will eventually get back the full claim. Can this be done with a credit card?
One card i claimed £1141.55 with interest, they offered me £348 and the other i claimed £594.80 and they offered £232.
They did send a polite letter saying why the fees are charged i.e. late payment or over your limit. Also they explained that i had a credit card agreement which i signed stating that i would agree to the Terms and Conditions.
They went on to say they believe a £20 fine is fair and lawfull but reduced it to £12 to be in line with competitors.
They appreciate ive incurred fees at the higher rate and as a matter of goodwill all the old fees that were charged @ £20, were reduced to £12 and the difference refunded to me above.
At this stage with the banks you say go through the small claims to get the rest of your money. Will i be able to do this? I think the settlement is far too small to agree with.
Also they said they would debit my account with the settlement if i agreed. Can they do this? or can i ask for the money as a cheque?Claiming against Lloyds TSB

Have a read of these previous posts regarding Capital One and you'll find other people who are at the court stage with them.
It would appear some people are being issued with cheques rather than a credit to their accounts.0 -

Hi
Can I have your opinions please?
My Capital One limit is £200. They slapped a late payment charge onto my account, as I was a week late in making a payment, and this charge took me over my limit, which then has snowballed my balance each month, as I couldn't keep up with all the charges they kept putting on, until my balance hit £430.
I wrote to Capital One (sent by Special Delivery) and I have checked with Royal Mail, who confirms it was delivered on 19/01/07.
I used the initial letter template from this website, requesting that they refund all charges, and provide me a copy of all my statements so that I can check they have offered me a full refund. I ended the letter stating that I expected a full response in 14 days.
The day after sending this letter, I got a standard letter from them advising they were registering an account default onto my credit file. These letters obviously crossed in the post.
To date, I have not had the courtesy of a reply, or even an acknowledgement, however, I have been telephoned at work (twice) by a company called Frederickson International, who said they are debt collectors acting on behalf of Capital One.
I advised them that I had registered a dispute with Capital One, and they simply replied that I had done so after the date they had been instructed by them, I was basically wasting my time!
I know that the 14 days is not up until Friday 2nd January 2007. What would you suggest I do on that date, if I haven’t heard anything from Capital One? Should I pursue this, or am I wasting my time like the DCA said?
Thanks in advance....0
