    Hi there everyone,

I could use a bit of advise, I have had no response from Cap. 1 after my 2nd letter (accepting part payment, still claiming the rest). As I live in Scotland, do I make a claim through my local court, or can I do it on the MCOL website as the company is from England.

I might be being a bit thick with this, but better to be safe than sorry. Still had no response from NatWest what-so-ever, so I will have to do the same with them.

    Cheers,

    Duncan

    Hi Duncan,

As I don't live in Scotland I am unable to help but I have put the link to the thread for people claiming in Scotland.

    Hope this helps :)

Back in 2005 began a new job, less money but regular pay etc from what was doing before.
in the begining for about 3 months could not pay full minimum amount as they wanted £150- £200, this went up to £600 then to £900, had been phoning them, I had told them that I was not working and the job I got did not pay till end of Oct by then nothing had come into household for 4 months, basic answer was tough!
After months of problems and arrogance by Cap One in which they could not admit an original interest freeze deal was valid, an agreement they had suggested. Worked out a payment deal with the debt agency.
My debt went from £2300 to £3600 with about £500 paid in by myself, the charges and interest alone swollowed up all my payments.
If I was to try to get charges back I still do not think I would get enough to clear the actual debt to clear it, could they close the agreement and demand full payment of all the debt if I was to reclaim?
Have never missed a payment of agreement!

After sending 2nd letter off- recieved letter today... which included the below...

As explained , we a re confident our fees are both fair and legal and im disapointed you are considering court action...the oft havent told us that we're oblidged to refund any fees, i am not prepared to refund all the fees weve added as you asked...
Financial regulations require me to advise you this is my final response in relation to this matter, however you have the option to contact the financial ombudsman....

    advice ?

Go to the next step - I've claimed twice from Capital One and received all these kind of put off letters. Just went ahead with my claim and won on both accounts - full amount + court fee + interest ;)
